Grand Island teen is cleared of robbery, assault charges

A Grand Island teenager has been cleared of robbery and assault charges in connection with an Oct. 25 incident that sheriff's deputies at the time called a drug deal gone bad.

Two other people still face charges.

Erie County District Attorney Frank J. Clark said Wednesday that a grand jury found insufficient evidence against Levi G. Phillips, 17, and that Phillips has been cleared on charges of robbery, assault and a weapons offense.

Timothy J. Higgins, 19, of no permanent address, has pleaded guilty to a reduced charge of third-degree robbery and is awaiting sentencing, Clark said.

Eugene A. Todie, 20, of Kenmore, faces a charge of first-degree robbery.

The three were arrested after a 19-year-old Grand Island man was robbed and choked in a car after the victim allegedly tried to buy marijuana, deputies said.
