A regular meeting of the Town Board of Grand Island, New York was held at the Town Hall, 2255 Baseline Rd., Grand Island, NY at 8:00 PM on the 18th of October 2004.

Supervisor McMahon gave the Invocation. 

Councilman Gary Roesch led the Pledge of Allegiance. 

Supervisor McMahon called the meeting to order at 8:00PM.

A motion was made by Councilwoman Cooke, seconded by Councilman Crawford to approve the consent agenda as distributed with the exception of Item #11 that was referred to the Zoning Officer to notify the adjoining neighbors of their intent to build, and Item #26 was referred to the Town Attorney.

A motion was made by Councilman Crawford, seconded by Councilman Roesch to set a Public Hearing for Monday November 1, 2004 at 8:00pm for the purpose of hearing anyone who wishes to comment in favor of or against the Town of Grand Island 2005 Budget.

Request to Advertise for Long-Range Planning Committee

A motion was made by Councilman Roesch, seconded by Councilwoman Cooke to advertise for three Members at Large for the Long-Range Planning Committee.

Appointment to Board of Ethics Committee

A motion was made by Councilman Crawford, seconded by Councilman Robillard to appoint Victor Gagliardi, 27 Adel Lane to the Board of Ethics Committee with a term to expire December 31, 2005.

Request to Advertise for Advisory Board Openings: Communications/Cable Committee and Zoning Board of Appeals Alternate Member

Currently, there are openings on the Communications/Cable Committee and an alternate on the Zoning Board of Appeals.

A motion was made by Councilman Robillard, seconded by Councilwoman Cooke to advertise for all possible appointments to openings on Advisory Boards for the upcoming 2005-year.

Erie County Snowplow Contract

The letter received from Erie County stated a reduction in vital services and programs including snowplowing that could end January 1, 2005.  The Supervisor met with the county executive and Erie County will honor the county contract through April 2005 when it expires at which time the county will put snowplowing out for an RFP.  No action required, for information only.

 

Erie County Police Protection

The letter received from Erie County stated a reduction in vital services and programs including Sheriff’s Road Patrol police services that could end January 1, 2005, without towns and villages reimbursement. 

A motion was made by Councilman Crawford, seconded by Councilwoman Cooke to refer the letter from Erie County regarding Sheriff’s Road Patrol police services to the Town Board for review.

Request to Submit Erie County Community Development Block Grant Application

A motion was made by Councilman Robillard, seconded by Councilman Roesch to authorize the Supervisor to sign the Erie County Development Block Grant Application for a Bicycle Path from Sidway School north to Bedell Road, and along Bedell Road from the Bike Path the Veterans Park at a total cost of $120,000, with the grant being $90,000.

Request for Speed Study – East River Road Between Fix/Broadway Rds. & “S” Curve on Stony Point Between Ransom/Huth Rds.

A motion was made by Councilman Crawford, seconded by Councilwoman to authorize the Supervisor to request the Erie County department of Highways to conduct a speed study on East River Road between Fix and Broadway and the “S” curve on Stony Point Road between Ransom and Huth Roads.

Budget Amendment – Records Management Grant Final Payment

The Town Clerk has applied for and received the third and final payment in the amount of $1067.00 to be applied to the 2003-2004 Federal /State Grant for the Preservation of Records. 

A motion was made by Councilman Robillard, seconded by Councilwoman Cooke to amend the budget as follows: Increase Revenue - 001.001.3060 State Aid - Records Management $1067.00, Increase Expenditure - 001.1410.0416 Town Clerk - Preservation of Records $1067.00.

TOWN ENGINEER – JOHN WHITNEY:

Grand Park Vue Estates – Public Improvement Permit – Section 4

The application has been reviewed, the fees have been paid and the Town Engineer recommends approval.

A motion was made by Councilman Robillard, seconded by Councilwoman Cooke to authorize the Town Engineer to issue a Public Improvement Permit to construct the waterline, storm sewer, sanitary sewer and roadway to serve 21 lots for Grand Park Vue Estates – Section 4.

Waste Collection & Disposal – Award Bid

Town Engineer John Whitney reported that he had opened the bids on September 29, 2004 for the collection and disposal of solid waste and recyclable in the Townwide Refuse & Garbage District #1.  Five bids were received from the following:

Republic Services of NY, d.b.a. Upstate Disposal                     $821,898.00

BFI Waste Systems of North America Inc.                           $879,822.00

Modern Corporations                                                              $898,282.33

Waste Management                                                              $991,800.00

NEI Waste Services                                                                    $1,136,137.00

After careful review of the bids, Mr. Whitney recommended the low bidder, Republic Services of NY, d.b.a. Upstate Disposal be awarded the contract in the amount of $821,898.00.  This price is base on 6,523 dwelling units, which reflects $126.00 per dwelling.  This bid is a 10.3% increase over the current annual charge.  They met all the specifications required.

A motion was made by Councilman Robillard, seconded by Councilman Roesch to award the 2005 Townwide Refuse & Garbage District #1contract to Republic Services of NY, d.b.a. Upstate Disposal in the amount of $821,898.00 and to authorize the Supervisor to sign the contract and deny the request to segregate recycling subject to the approval of the Town Attorney.

In addition, the following alternate bids to collect and dispose of solid waste and recyclables at the Town facilities were also received:

Modern Corporations                                                              $9,131.52

NEI Waste Services                                                                    $5,743.62       

Waste Management submitted an alternate bid based on the award of the base bid.  Since they were not low bidders for the base bid, their alternate bid was not considered.  After careful review, Mr. Whitney recommended award of the alternate bid to the low bidder, BFI Waste Systems of North America Inc. in the amount of $5,452.24.

A motion was made by Councilwoman Cooke, seconded by Councilman Robillard to award the alternate bid to BFI Waste Systems of North America Inc. in the amount of $5,452.24.

A motion was made by Councilwoman Cooke, seconded by Councilman Robillard to authorize the Town Engineer to advertise for bids the Golden Age Center Vestibule – Job No. M-173 and that bids will be opened on Wednesday, November 3, 2004 at 10:00am.

A motion was made by Councilman Robillard, seconded by Crawford to authorize the Code Enforcement Officer to issue a temporary Certificate of Occupancy for Fuccillo Toyota, 1974 Alvin Road.

A motion was made by Councilman Robillard, seconded by Councilwoman Cooke to accept the Planning Board’s recommendation and grant Exception to Subdivision Regulations and to divide two lots facing Whitehaven Road and split them into three lots facing Meadow Lane as requested.

A motion by Councilman Roesch, seconded by Councilman Robillard was made to accept the Planning Board’s recommendation to approve the request to fill, regrade and landscape waterfront property at 2120 East River Road including a stone breakwall and dock improvements contingent on the Corp and DEC permits.

A motion was made by Councilman Crawford, seconded by Councilman Roesch to authorize the Code Enforcement Officer to issue a building permit for a model home on Briarwood prior to formal acceptance of the road, subject to the Town Attorney approval.

Councilwoman Cooke: Speed Studies do not guarantee a speed reduction, sometimes the speed stays the same, is lowered and sometimes it’s raised.

Supervisor McMahon: Volunteers needed for Kids Voting – Call the Supervisor or any Councilmember to be put in touch with Lee Tetkowski, the Kids Voting Chairperson.
