A regular meeting of the Town Board of Grand Island, New York was held at the Town Hall, 2255 Baseline Rd., Grand Island, NY at 8:00p.m. on the 2nd of April 2007.

Supervisor McMahon called the meeting to order at 8:00p.m.

Reverend David Rodgers from Emmanuel Community Bible Church gave the Invocation. 

Councilwoman Susan J. Argy led the Pledge of Allegiance.

SUPERVISOR McMAHON:

Procedure for Recreation Fee Collection

A motion was made by Councilwoman Cooke, seconded by Councilwoman Argy to approve the resolution establishing a procedure for collecting Recreation Fees for subdivisions seeking a waiver of subdivision requirements as follows:

       WHEREAS, the Town of Grand Island Town Board has a procedure by which it will consider requests to waive its subdivision procedures; and

       WHEREAS, in virtually every situation said request involves too little land to permit the dedication of land for recreation purposes and therefore the Town Board imposes the alternative recreation fee instead; and

       WHEREAS, unlike regular subdivisions requests where additional approvals can be withheld if the recreation fee is not paid, in cases of subdivision waiver it is difficult to collect the fee if it is not paid before the grant of the waiver.

       NOW, THEREFORE, the Town Board of the Town of Grand Island resolves as follows:

1.    The following procedure shall be employed in all cases where a subdivision waiver is requested, except for those situations involving movement of property lines only that do not result in the creation of a new lot.

a.      The Recreation Fee per new lot shall be paid in advance at the time of requesting the waiver.  The waiver shall not be considered without said payment.

b.      If the waiver is not granted, or if the Board requires a dedication of land for recreational purposes, the fee shall be reimbursed.  No further action of the Town Board shall be necessary to approve the reimbursement.

     2.  This Resolution shall be effective immediately.

A motion was made by Councilwoman Cooke, seconded by Councilman Crawford to authorize the Supervisor to sign the project amendment to extend the Department of State’s funding for the Scenic Woods/Bicentennial Park Master Plan project through December 31, 2007.
