regarding the temporary closure of Town streets in connection with block
parties and similar neighborhood events.

Law #7/2006 regarding the temporary closure of Town streets in connection with
block parties and similar neighborhood events as follows:
SECTION 1 - ENACTMENT
Be it hereby
enacted by the Town Board of the Town of Grand Island that a new section of the
Town Code, numbered § 6A shall be added as follows:
§6A-1: PURPOSE
The Town of
Grand Island, New York finds that from time to time certain neighborhood groups
desire to have town streets closed for the purpose of conducting block parties
or similar neighborhood events. The
purpose of this local law is to protect the health, safety and well-being of persons
and property by imposing restrictions and establishing procedures for the
granting of permits authorizing the temporary closure of streets within the
Town for such parties.
§6A-2: DEFINITIONS
As used in this
ordinance, unless the context requires otherwise, the following terms shall have
the following meanings:
PARTY -- A
neighborhood block party, celebration or event as provided in Town Law, §64
(10-b), sponsored solely by real property owners, but shall not include a
garage sale, yard sale, bazaar, rummage sale, or other similar activity having
the principal purpose as fund raising for an individual or an organization, nor
shall it include a political meeting or rally, carnival, theatrical or musical
performances such as rock concerts or similar events.
STREET -- A town street, highway or road.
APPLICANT
-- Party sponsor and real property
owner in the Town who must be at least eighteen (18) years of age.
§6A-3: APPLICATION
A. The Town Board shall be authorized to issue a
permit for the temporary blocking of a street for the purpose of holding a
party.
B. An application for such permit shall be filed
with the Town Clerk at least twenty (20) days before and no more than one (1)
year before party date.
C. Application shall contain at least the
following information:
(i) Name of applicants, sponsoring organization,
if any, and the address and telephone numbers of each;
(ii) Name
of the street or streets where party will be held including
description/addresses of the portions thereof to be blocked; and
(iii) Description of the party to be held including
date and hours of the party and rain date, if any.
D. The applicant may be required to provide such
additional information, as the Town Board shall prescribe by resolution.
§6A-4: NOTICE OF
PUBLIC HEARING
The Town Clerk
shall cause a notice of a public hearing on the application to be published in
an official Town newspaper, which publication shall be not less than five (5)
days before the date of the hearing.
§6A-5: PUBLIC
HEARING
At the public
hearing, the Town Board shall examine the completed application for the party
and street closing permit. Based on an
affirmative examination, the Town Board will adopt regulations setting forth
terms and conditions for issuance of a permit.
§6A-6: ISSUANCE OF
PERMIT
Upon approval by
the Town Board, the Town Clerk shall issue a permit upon a determination that
the party is authorized by State and Local Laws and regulations.
Immediately upon
granting a permit, the Town Board will direct the Town Clerk to draft a
resolution to issue permit with notification of such to the applicant, highway
department, zoning, town police, sheriffs department, and state troopers.
§6A-7: DENIAL OF
PERMIT
The permit shall
be denied if the Town Board finds that blocking the street or portion thereof,
on the date requested in the application, will unduly interfere with the flow
of vehicular traffic, access to property, may constitute a threat to public
safety and welfare, or upon determining that the party is not authorized
pursuant to the Town Code or State Laws.
§6A-8: PERMIT
VALIDITY
A permit issued
pursuant to this local law shall be valid only for the date and the hours
specified on the application, which shall not be before 9:00 a.m. and after
12:00 midnight. The Town Board shall
have the authority to revoke a permit at any time if it determines that any
condition of the permit has not been met or is violated. A decision by the Town
Board to revoke the permit is final.
§6A-9: REMOVAL OF
LITTER AND DEBRIS
The applicant
shall be responsible for removal of litter, debris and other materials from the
street, or portion thereof used for the party, which is attributable to or
caused by the party and if not removed by the applicant may be removed by the
town and the cost thereof charged to the applicant.
§6A-10:
NOTIFICATION
The applicant is
responsible for and must notify all abutting residents within ten (10) days
before commencement of party.
§6A-11: BLOCKING OF
ROADS
Prior to the
commencement of party, the Town Board shall request that the Town Superintendent
of Highways cause the street, or portion thereof, to be blocked to motor
vehicles except authorized emergency or hazard vehicles, as defined in the
vehicle and traffic law, and to provide detour signs for vehicular traffic. No
other person shall in any manner block or place barricades in the road.
A street or
portion thereof blocked off for a party shall not be obstructed by barricades
or obstacles which cannot be readily moved to allow emergency and hazard
vehicles to enter it in response to an emergency.
SECTION 2 - AUTHORITY
This Local Law
is adopted pursuant to the authority vested in the Town pursuant to the New York Constitution,
Article IX, §2 and the N.Y. Municipal Home Rule Law §10.
SECTION 3 - EFFECTIVE DATE
This
Local Law shall be effective upon filing with the Secretary of State.

previously the Town Board of the Town of Grand Island, received a petition,
signed and acknowledged in the manner required by law by sufficient number of
property owners, together with a map, plan and report for the creation of the
Hidden Oaks Subdivision - Phase 2 Lighting District No. 48, Town of Grand
Island, the boundaries of which said district are set forth below, and the
improvements proposed consist of an electric street lighting system serving
said district; and
WHEREAS,
pursuant to an Order adopted by this Town Board on the 7th day
of August, 2006, reciting the filing of
the map, plan and report, the improvements proposed, the method of financing,
the boundaries of the proposed Creation and all other matters required to be
stated by law, the Town Board of the Town of Grand Island held a duly noticed
public hearing at the Town Hall, 2255 Baseline Road, Grand Island, New York at
8:00 p.m. on August 21, 2006, to consider creation of said district including
the environmental significance thereof and to hear all persons interested in
the subject thereof, concerning the same, and for such other further action on
the part of said Town Board, with relation to the proposed district.
NOW THEREFORE BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN
OF GRAND ISLAND as follows:
1. Establishment
of the Lighting District will not have a significant adverse impact on the
environment and therefore a Negative Declaration of Environmental Significance
has been issued for the creation of this District.
2. That
the Petition is signed and acknowledged or proved or authenticated as required
by law, and is otherwise sufficient.
3. That
the notice of public hearing was duly published and posted as required by law,
and is otherwise sufficient.
4.
That all properties and
property owners benefited by the improvements are included in the District.
5.
That all properties and
property owners included in the District are benefited thereby.
6.
That it is in the public
interest to create the Lighting District.
7.
That creation of the
District as set forth in the map, plan and report is approved, that the
performance of supplying electrical street lighting service be contracted for
by the Town Board acting for and on behalf of the District for the illumination
of streets or highways in said District pursuant to the provisions of New York
Town Law ' 198(6), with an annual total charge not to exceed
$1,105.89, which said expense shall be levied and collected from the several
lots and parcels of land within said District, as bounded and described as
follows:
