A regular meeting of the Town Board of Grand Island, New York was held at the Town Hall, 2255 Baseline Rd., Grand Island, NY at 8:00p.m. on the 3rd of March, 2008.

Supervisor Peter McMahon called the meeting to order at 8:00p.m.

Rev. Mark Rogers from Whitehaven Road Baptist Church gave the Invocation. 

Councilman Gary G. Roesch led the Pledge of Allegiance.

Court – Part-time Hire

A motion was made by Councilman Crawford, seconded by Councilman Roesch to appoint Kathy Fratello as a Clerk, part-time, Grade 3, Step A effective March 4, 2008.

School Resource Officers

A motion was made by Councilman Crawford, seconded by Councilman Roesch to adopt the following resolution urging Governor Spitzer to retain the School Resource Officer Program:

            WHEREAS,  ensuring the safety of Grand Island Central School District students and staff is a priority of the Town of Grand Island;  and

          WHEREAS,  the presence of a New York State Trooper to serve the District as its School Resource Officer (SRO), provides a high degree of added safety;  and

          WHEREAS,  Governor Eliot Spitzer, who has pledged to provide programs to ensure the safety of New York State public schools, has proposed to eliminate this important program; now therefore

          BE IT RESOLVED,  that the Town Board of the Town of Grand Island urges Governor Spitzer to rescind his decision to eliminate the SRO program in schools across New York State, thus keeping his promise to provide safe schools for students and staff; and

          BE IT FURTHER RESOLVED,  that a certified copy of this resolution be sent to Governor Spitzer, with additional copies sent to State Senate Majority Leader Joseph Bruno, Senator Antoine Thompson,  State Assembly Speaker Sheldon Silver, Assemblymember Sam Hoyt, and the Grand Island School Board.

2008 Sludge Hauling Contract

A motion was made by Councilman Crawford, seconded by Councilwoman Argy that in the event Ball Sanitation is unable to perform according to the contract that the Town Engineer is authorized to sign a contract on an emergency basis for sludge hauling in a manner consistent with the Town’s bid specifications for a period of time not to exceed 60 days.

HIGHWAY SUPERINTENDENT – RAYMOND DLUGOKINSKI:

Award Bid – 2008 9’ Insulated Asphalt Dump Body

Highway Superintendent Ray Dlugokinski reported that the bids were opened on February 27, 2008 for a 2008 9’ insulated asphalt dump body.  One bid was received from the following:

 

Viking-Cives                           $29,720.00

 

After careful review of the bids, Mr. Dlugokinski recommended the sole bidder, Viking-Cives be awarded the bid in the amount of $29,720.00.

A motion was made by Councilwoman Cooke, seconded by Councilwoman Argy to authorize the Highway Superintendent to award the bid for a 2008 9’ insulated asphalt dump body in the amount of $29,720.00.

Award Bid – 2008 9’ All Season Dump Box

Highway Superintendent Ray Dlugokinski reported that the bids were opened on February 27, 2008 for a 2008 9’ all season dump box.  One bid was received from the following:

 

Viking-Cives                           $21,476.00

 

After careful review of the bids, Mr. Dlugokinski recommended the sole bidder, Viking-Cives be awarded the bid in the amount of $21,476.00.

A motion was made by Councilman Crawford, seconded by Councilman Roesch to authorize the Highway Superintendent to award the bid for a 2008 9’ all season dump box in the amount of $21,476.00.

Bid – 2008 10’ Salt Spreader Body

Highway Superintendent reported that there were no bids received for the 2008 10’ salt spreader body.  The request to bid will be at a later date.

DEPARTMENT OF ENGINEERING & WATER RESOURCES – JOHN WHITNEY:

Award Contract – ORF Spray Wash System and Liner Replacement – M-182

Town Engineer John Whitney reported that the bids were opened on February 27, 2008 for the ORF spray wash system and liner replacement project.  Four bids were received for the General Contract and three bids were received for the Electrical Contract from the following:

 

General Contract -

Nichols, Long & Moore                          $ 604,920.00

Armand Cerrone                                              $ 703,800.00

Kandy Corporation                                        $ 796,880.00                

Pinto Construction                                        $ 867,936.00

 

Electrical Contract -

O’Connell Electric                                              $ 27,340.00

CIR Electric                                                          $ 42,900.00

Weydman Electric                                              $ 44,747.00                   

 

After careful review of the bids, Mr. Whitney recommended the low bidders, Nichols, Long & Moore for the General Contract in the amount of $604,920.00 and O’Connell Electric for the Electrical Contract in the amount of $27,340.00 be awarded the bids.

A motion was made by Councilwoman Cooke, seconded by Councilman Roesch to accept Mr. Whitney’s request for low bidders Nichols, Long & Moore for the General Contract in the amount of $604,920.00 and O’Connell Electric for the Electrical Contract in the amount of $27,340.00 be awarded the bids.

RECREATION DIRECTOR – LINDA TUFILLARO:

Request to Advertise for Bids – 60 Inch Seeder

A motion was made by Councilwoman Argy, seconded by Councilwoman Cooke to authorize the Recreation Director to advertise for bids for a 60 inch seeder to be used at Veterans Park and additional park areas.

A motion was made by Councilman Crawford, seconded by Councilwoman Argy to renew the Special Use Permit for Glen Wallace, North Colony Road for a Bed & Breakfast.  The site has been inspected and it is unchanged.

A motion was made by Councilwoman Argy, seconded by Councilman Roesch to refer the request to rezone 2038 Grand Island Blvd. from John R. Simon and Terry Mesmer to the Planning Board for review and recommendation.

A motion was made by Councilman Crawford, seconded by Councilwoman Cooke to set a Public Hearing for Monday, March 17, 2008 at 8:00p.m. for the purpose of hearing anyone who wants to comment in favor or in opposition to proposed Local Law Intro #2/2008, to amend the zoning map from John R. Simon and Terry Mesmer, 2038 Grand Island Boulevard from TCMR to B-1.

Temporary Modular Offices (Trailers) – American Pharmaceutical Partners, Inc.

A motion was made by Councilman Roesch, seconded by Councilwoman Cooke to accept the request of the Zoning Officer, CEO and Assistant Municipal Engineer and approve the use of temporary modular offices for American Pharmaceutical Partners, Inc. during the construction phase of the planned expansion.
