Town of Grand Island Part-Time Dog Control Officer - 2006

   The position of Part-Time Dog Control Officer involves responding to various dog and/or other animal complaints on weekends and/or when the full-time dog control officer is unavailable. Work is performed under the direction of the full-time dog control officer or the Town Board. Applicants should posses a good knowledge of the community, valid NYS driver’s license, and ability to handle dogs or other animals. High school diploma, GED or equivalent experience and training required. Pay is $12.12/hr. Any interested community member should submit a letter detailing his/her qualifications to:

Park Place Patio Home Public Hearing Postponed

   Monday, July 3, 2006 . . .A public hearing, Monday, to air the Park Place Patio Home project was rescheduled for 8 p.m. Monday, July 17 due to an error in the public hearing notice that said discussion would consider preliminary plat approval. It should have read cluster development approval.
   A second public hearing regarding Jerod and Jim Battaglia’s request to rezone 2569 Whitehaven Road from M1-M2 for a contractor’s yard brought questions and comments regarding specifics of the project. Since there is no site plan yet, residents were asked to follow the project and were told they would have another chance to speak at a subsequent public hearing following Planning Board action.
   Barbara Johnson, who lives across the street from the property, voiced concerns about the traffic problems on Whitehaven from Fuccillo Automotive group test driving cars at 80 miles an hour to senior citizens driving slowly. She stated that failure to grade the road made it unsafe and said she didn’t allow her children to bike on the road. Johnson concluded that additional traffic with the addition of a contractor’s yard would just add to the safety concerns. The rezoning request was referred to the Planning Board for review and recommendation.
   Public hearings were set for 8 p.m. July 17 to consider closing roads for two block parties: Park Place, Bonnywoods and Forest Creek August 20 from 1:30-8 p.m. and through traffic on Wallace Drive between Huth Road and South Park from 2-4 p.m.
   Referred to the Conservation Commission was a Deed of Conservation Easement between the Town and Fuccillo Automotive Group that would protect the wetlands on the property. This easement would assure that the property will be retained forever in its wetland conditions and prevent any use of the property that would impair or interfere with the conservation values of the property.
   Councilwoman Mary Cooke announced that the town was given a grant in the amount of $10,000 from the State Department of Environmental Conservation for eradication of two acres of purple loosestrife using herbivorous insects (beetles). The Town will match the $10,000 amount.
   The Town Board accepted as complete the Final Supplemental Generic Environmental Impact Statement for the Local Waterfront Revitalization Plan. Involved was an update of potential environmental impacts with revisions circulated to the Department of State and to appropriate local, county, state and federal agencies in accordance with the requirements of Executive Law, Article 42 and Part 617 of the implementing regulations for Article 8 of the Environment Conservation Law.
   Rezoning was approved for Gun Creek, a residential mixed use development on 98.5 acres east of Stony Point and off Whitehaven Road. The project, as described by the developer, is a creative use of the land that would have 41 estate lots, 52 family lots, 83 patio homes and 98 town houses designed around green space as a focal point.

Public Referendum Set On Firefighters Service Award Increase

   Monday, July 3, 2006 . . .Voters will go to the polls in a special election August 8 from noon to 8 p.m. to decide if Grand Island firemen’s service award should be increased from $480 to $590 for 2007 and be increased from $590.00 to $700.00 for 2008 and beyond.
   Grand Island Fire Company also wants to amend its Length of Service Award Program and change Provision #3 which gives an automatic 25 points to each elected and appointed official. The new #3 sets a maximum of 15 points for miscellaneous activities - "Participation in activities covered by the Volunteer Firefighters’ Benefit Law including but not limited to participation by paramedics and advanced EMTs in quality assurance meetings, Senior Assistance visits, fire prevention and education activities, a sitting member and participant in committee or Board of Directors meetings and other activities defined by the Administrator as being necessary to the operation of the Fire Company for the purpose of improving service to the community. One point per session of at least two hours in duration."
   The election, which will be held at Grand Island Fire Headquarters at 2275 Baseline Road, is open to all registered voters in the town. Absentee ballots will be available at the Erie County Board of Elections or from the Grand Island Town Clerk. Six election inspectors will oversee the vote – three Republicans and three Democrats to be named by the inspector chairpersons. The Fire Company will assume all costs associated with this referendum.

Changes In Town’s Performance Service Contract Approved

   Monday, July 3, 2006 . . . Additional work in the amount of $132,000 for improvements to town facilities was approved Monday. Change orders included:
• $34,400 for costs associated with installation of an emergency generator at the Golden Age Center.
• $16,988 for installation of HVAC in the Golden Age Center kitchen.
• $14,542.72 for modifications to the courtroom heating and air conditioning.
• $3,124.80 for installation of window tint to the Town Hall first floor windows.
• $28,518.76 for installation of doors and windows at the Highway Garage.
   The additional costs are within the original amount authorized.
   A change order for the Golden Age Center roof replacement was approved that will take care of a severely deteriorated atrium skylight and repairs to the building exterior. This will result in a net increase to the contract of $82,368. Funds for this are available under the original borrowing as reimbursements from the participating grant program have offset planned indebtedness.
   Supervisor Peter McMahon was authorized to sign a grant disbursement agreement for the Community Capital Assistance Program Grant ($50,000 from Sam Hoyt) to construct lavatories at Veterans Park.
   In other business, the board:
• Approved the hiring of one part-time seasonal laborer as summer help in the Wastewater Department at the rate of $8.25 per hour effective July 10.
• Approved hiring Patricia Kostenbauder and Jill Sweeney (at $15 per hour) as instructors in the Summer Youth Program and Roger Wright and Susan Szczublewski (at $20 per hour) for the Summer Nature Program.
• Accepted with regret the resignation of Dog Control Officer Robert Meyer and approved advertising for a replacement.
• Authorized advertising for a medium size dump truck for the Water Department.
• Granted a special use renewal to Florence Prawel for the keeping of three horses at 2400 Fix Road.
• Referred to the Town Board a letter requesting negotiations for a successor agreement between American Federation of State, County and Municipal Employees, AFL-CIO and the Town.
• Corrected by amendment the measurement of an abandoned paper street, Fourth Street, from 150 ft. to 157.24 ft.

Town Proclaims July 15 Friends of Lynnette Bike Tour Day

   Monday, July 3, 2006 . . .A large contingent of friends of Lynnette Grisanti was on hand Monday to receive a proclamation in honor of the 13th Annual Bike Tour in memory of Lynnette and her eight-week-old grandson, both of whom died of cancer. The Bike Tour will take place Saturday, July 15 with registration beginning at 8:15 a.m. at the Nike Base. Two tours are offered – one at 10 miles and one at 22 miles. A Chinese auction is another feature of this year’s event. A preview of the Chinese auction items will be held from 6:30-8:30 p.m. on the 14th. Ticket sales begin at 8 a.m. on the 15th with drawings to begin at 9:30 a.m.
   Bike tour proceeds benefit Friends of Children with Cancer at Roswell Cancer Institute. Over the past 12 years more than $40,000 have been donated to Roswell from this Isle event. The Town Board encouraged all residents to support the cause.

G.I. Fire in the Sky 2006 - Largest Aerial Fireworks Display In WNY

   "This is to be one of the ‘largest aerial fireworks displays in Western New York,” said Grand Island Town Supervisor Peter McMahon on the announcement of this year’s July 4th fireworks display, scheduled for dusk at Martin’s Fantasy Island.
   Bill Minnich, Jr., President of Premier Pyrotechnics, Inc., said that more than 1,000 aerial shells will light the sky over the theme park this Tuesday evening, July 4.
   Martin’s Fantasy Island and Astellas Pharma Mfg., Inc. have again renewed their sponsorship of the display. Astellas Pharma was the catalyst for the original expansion of this display in 1998, and since then, more than 25,000 spectators have enjoyed the show.
   Martin’s Fantasy Island will be the only place to view the ground display. Beginning at 5 p.m., Grand Island residents can gain free admission to the park with photo identification and proof of Grand Island residency (adults).
   “The 2006 display will be spectacular,” said Mr. McMahon.

No parking along Grand Island Boulevard between Whitehaven and KOA campground;

Illegally parked vehicles will be ticketed and towed.

Thruway Ramp Closure
The on-ramp from Whitehaven Road to the I-190 northbound will be closed from approximately 9:00 p.m. until the end of the fireworks display.

Residents Object To Proposed Waterford Subdivision

   Monday, May 19, 2006 . . .Planning Board Chairman Doug Scheid Monday gave a lengthy presentation on the proposed Waterford subdivision bounded by Riverview Court, East River Road, Riverdale Drive and Beaver Island Parkway. He explained that as a person of interest in the project he had recused himself from any decision making at the planning board level. Using visual via PowerPoint and a poster board during the public hearing, he talked about five phases for the development that would begin with 14 lots. At build out there would be 70 single family homes on lot sizes of 80 by 160. There would be two retention ponds and an east and west loop road. The project would go from Stony Point to East River Road.
   In describing the history of the land he said there had been archeological diggings with no significant findings and said that a small area of wetlands would be filled in.
   Speaking against the development, Nan Hoffman presented a petition with 157 signatures and cited adverse traffic and environmental impact. She asked the town board not to render a decision prior to extensive traffic and environmental studies. She further mentioned that people do not observe the speed limit on the dangerous East River S curve that the project would impact.
   James Bialek voiced concerns about the destruction of wetlands and green space and wondered why the developers would impact Stony Point with traffic from the development rather than utilize the Parkway.
   Traffic safety issues were also raised by Donald Wilkinson who said the project would result in "a disaster waiting to happen." Linda Holcomb mentioned there were no sidewalks on Stony Point and Jackie Farrell cited numerous accidents on the S curve. Quality of life and wildlife concerns were also aired.
   The town board referred the preliminary plat for Waterford Subdivision back to the town board for further review and referred a special use application by Cyrus Ardalan of East River Road for the keeping of ten horses on 50 acres to the planning board. Chris Stange, though not objecting to the special use permit per se, had questions regarding the particulars of the application.
   The town board set two public hearings for July 3 at 8 p.m. - one to consider a rezoning change from M1 to M2 by Jerod and Jim Bataglia for a contractor's yard at 2569 Whitehaven Road. The second will air a preliminary plan for Park Place Patio Homes on Whitehaven Road. George White of Harvey Road spoke against the patio homes saying it would change the character of the R1-D neighborhood.

   Monday, May 19, 2006 . . .A town board proclamation Monday recognized Michael Heftka and the Small Business Development Center's award winning KidBiz project and the 10th anniversary of the event on Grand Island. Sue Hillock was sited for her work in coordinating KidBiz and growing the event from 30 kids to more than 100. KidBiz teaches children how to set up a business and gives them an opportunity to rent space and sell crafts, used toys, food items etc. A training session prior to the event focuses on customer service tips, display of merchandise, pricing and a must have list to do business (change, bags, signs).
   This year's KidBiz will headline at a Chamber of Commerce sponsored Isle Happenings from 10 a.m. to 3 p.m. Saturday, July 1st at the Town Commons near the gazebo. Whitehaven Road from Baseline to Grand Island Blvd. will be closed to traffic from 8 a.m. to 4 p.m. in an effort to provide a safe environment. The town will furnish barricades, police presence, porta potties, garbage cans and picnic tables.

   Monday, May 19, 2006 . . . Jeffrey and Andrew Stange, members of Troop 254 at Island Presbyterian Church, were presented Eagle Scout proclamations by the Town Board Monday. There mom, Chris, stood proudly by as Supervisor Peter McMahon acknowledged that these were the first brothers that he could remember who reached Eagle Scout status at the same time.
   Jeffrey's project was to assist the town hall in a server upgrade that involved computer software and hardware. He donated 242 hours to the project. Andrew was sited for constructing fox boxes for a fox wildlife refuge. His project took 122 hours to complete.

Fantasy Island To Host July 4th Fireworks

   Monday, May 19, 2006 . . .As in past years, the town announced Monday that Martin's Fantasy Island would be holding its annual fireworks display at dusk on Tuesday, July 4th. Astellas has donated $5000 to the town for the display. The rain date is Wednesday, July 5th.
   An auction of surplus town items including vehicles, office furniture and used sports equipment was approved for Saturday, July 15th. Advertisements will begin June 22nd. Bids for resurfacing various town roads will also be advertised beginning Friday, June 23 with bids to be received by July 12 at 10 a.m.
   Global signal acquisitions for IV has purchased the rights to three cell towers located on town property (318 Baseline Road, Carl Road and Bedell Road). The supervisor was authorized to sign contracts for 25-year leases subject to the approval of the town attorney. These leases will result in $570,000 revenue for the town over the 25-year period.
   A revised site plan for Island Farm Market at 2920 Grand Island Blvd. was approved with the following conditions: screening of bins and dumpster, changing the setback line, following the Grand Island Blvd. planting line, installing a sidewalk in the future, and indicating current and future phases.
   The town board approved the hiring of Nicole Morgan, David Cole, Steve Beatty, and Tim Boorady for the summer youth program. Kate Mekka was hired as a lifeguard. Returning hirees are Jolie Dahlstrom and Jill Endres.
   A town road to accommodate Park Place Subdivision (Phase VII) was granted subject to the approval of the town engineer, town attorney and the highway superintendent. Also approved were easements for turnaround public drainage and sanitary sewers. Release of turnaround easement were approved for Park Place Phases V and VI.
   In other business the town board:
• Appointed Joseph Donlon as principal engineer assistant effective July 1
• Appointed Sharon Szafran as a part-time clerk typist in the Recreation Department
• Waived subdivision regulations for Mary Beth Smith to combine four lots into three on Fix Road with the addresses to be 2655 and 2667
• Referred to the town board a letter of intent from Teamsters Local Union 264 to amend the collective bargaining agreement with the town
• Adopted a resolution objecting to Erie County Legislature's four-year plan that would eliminate Sheriff road patrols, the transfer of county roads to local control, an increase in the sales tax and an increase in county property tax.
• Reaffirmed preliminary approval for Island Meadows Subdivision to accommodate one additional lot
• Approved a bid from Eastwood Industries Inc. in the amount of $72,849.96 for the installation of a traffic signal at Staley and Baseline roads
• Granted a special use renewal for the keeping of an agricultural animal by Laura and Steven Gorcheck at 5302 East River Road
• Granted public improvement permits for water lines and sanitary sewers for Phase I of Golf Villas
• Referred to the town board a document to determine lead agency status on a plan for the Niagara River Greenway that would define goals, boundaries and management details
• Announced a Grand Island Blvd. cleanup project for Saturday, June 24 from 9 a.m. to 11 a.m. Volunteers are asked to wear old clothes and gloves and meet at town hall

      1282 Stony Pt. Rezoned R-3

   The Grand Island Town Board met Monday, June 5, 2006 at which time the request by Russ Certo to rezone his building at 1282 Stony Point from R1-E to R-3 was granted with the following restrictions:
• The use is for residential apartments with no other use.
• There is a limit of 3 residential units.
• The structure cannot be expanded in any way, either up or out.
• Hennepin Road parking cannot be expanded.
• Parking on Love Road will be reduced to a maximum of 8 spaces and the pavement will include a recreational area.

   A public hearing for Waterford Park subdivision (between Riverview and Riverdale, off Stony Point Road) was scheduled for 8 p.m. Monday, June 19, 2006. The proposal shows Stony Point Road extending onto East River Road on the S curve. Several people were at the board meeting to express concern. Only one spoke as they were told that the public hearing is in two weeks.
   The county is doing a hazardous waste drop off day at Erie County Community College South on June 17.
   Golf Course Villas (phase 1, 22 lots on eastern most portion of the plan) was granted final plat approval. The development is 122 patio homes west of River Oaks Golf Course on Whitehaven Road.
   A public hearing was set for Monday, June 19 for keeping 10 agricultural animals (horses) on 50 acres at 5345 East River Road.




TOWN PROSECUTOR – PART TIME - 2006

   The Town of Grand Island has an immediate opening for a back-up, part-time Town Prosecutor. Duties include Town Court in the absence of the regular Town Prosecutor. Salary $200/day.    Grand Island, NY – The Town of Grand Island is close to completing a municipal-wide, energy-efficiency upgrade project, involving six buildings and a wide range of energy improvements expected to save local taxpayers more than $66,000 annually. The project received $224,148 from the New York State Energy Research and Development Authority (NYSERDA).
   "The NYSERDA low interest grant made this project possible. We were able to make a number of energy saving improvements which would have been impossible without the grant. In the long run, the Town of Grand Island will save thousands of dollars in energy costs because of the work made possible by the grant,” said Grand Island Supervisor Peter McMahon.
   The project involved energy-efficiency improvement at multiple municipal properties including Wastewater Treatment Plant, Water Treatment Plant, Whitehaven Storage Tank/Pump Station, Town Hall, Highway Garage and Nike Recreation Center. Wendel Energy Services of Buffalo provided the technical evaluation of potential energy savings and coordinated the upgrade project.
   “This type of partnership yields tremendous benefits for local taxpayers in terms of lower municipal utility costs, as well as continues to strengthen the energy service sector of the State’s economy,” said NYSERDA President and CEO Peter R. Smith. “Supervisor McMahon and the Town Board should be congratulated for pursuing to lower governmental costs through enhanced energy efficiency.”
   Energy efficiency improvements included the installation of Energy Star-rated windows, lighting occupancy controls, T-8 lighting fixtures and retrofits, hardwired compact fluorescent fixtures, pulse start Metal Halide lights, LED exit signs and traffic signals, premium efficiency motors and variable speed drives.
   It is estimated that the Town of Grand Island will save approximately 726,999 kWh in annual in electric energy use and 410 mmBtu in gas use for a total annual energy savings of $66,345.
   Smith said NYSERDA provided financial incentives through two New York Energy $martSM programs to help reduce the end-cost of the energy-efficiency upgrades. A portion of the savings comes from incentives provided by the Commercial/Industrial Performance Program (CIPP), and additional savings came from accessing the Loan Fund program.
   The New York Energy $martSM Loan Fund provides for a four percent interest rate reduction on commercial loans secured for approved energy-efficient measures. The Town of Grand Island utilized the Loan Fund to borrow $1 million from Citibank NA to finance the purchase and installation of energy-efficient equipment and products. The Loan Fund reduced the amount of interest paid on the borrowed money by four percent, thereby reducing the base loan rate from 4.00 percent to zero percent interest, thereby saving local taxpayers $157,397 in interest charges.
   In addition, Smith said NYSERDA provided another $66,751 in financial incentives through the New York Energy $martSM Commercial/Industrial Performance Program (CIPP) to help reduce the end-cost of the energy-efficiency upgrades. Under the program, financial incentives provided by NYSERDA go directly to energy service companies to help lower the overall project cost and to help promote the development of the energy service company sector of the State's economy. In this instance, the Town of Grand Island worked with Wendel Energy Services to perform the upgrades.
   Funding for the Energy $martSM program, which NYSERDA administers on behalf of the Public Service Commission, comes from a charge on utility bills. The program has proven successful in lowering electricity costs for ratepayers by encouraging energy efficiency in businesses, homes, and municipalities. The programs are available to all electric distribution customers (residential, commercial, institutional, and industrial) of Central Hudson, Con Edison, NYSEG, Niagara Mohawk, Orange and Rockland, and Rochester Gas and Electric.
   New York Energy $martSM programs are funded by a System Benefits Charge (SBC) paid by electric distribution customers of participating utilities. NYSERDA, a public benefit corporation established by law in 1975, administers SBC funds and programs under an agreement with the Public Service Commission.

Medical Corridor Project Findings Is Focus Of EDAB Presentation - 2006

   The Grand Island Economic Development Advisory Board (EDAB) hosted a power point presentation on Thursday, May 18, 2006 at the Grand Island Town Hall, to discuss the Medical Corridor Project Findings. Interns from the University at Buffalo School of Management, Nicole Jarzyniecki and Jim Wahl, who have been working with the E.D. Advisory Board, presented the findings followed by a question and answer period.
   The Medical Corridor Project was initiated to determine what, if any, role Grand Island could play in the promotion and growth of a bi-national medical industry cluster in order to better understand what opportunities exist and what services are needed. Industry leaders at the government, organizational, and company level were interviewed to gain an inside perspective on the issues. Individuals from both the Canadian and American sides of the border contributed to this study.
   Even though those interviewed were diverse in terms of location, background, and industry focus, common themes were repeated throughout the project. The skilled labor pool, outstanding educational and research institutions, and relatively low costs of living were some of the strengths of the corridor that were commonly noted. However, some of the weaknesses echoed by multiple interviewees were the lack of financial incentives for doing business in Western New York, and from an international point of view, lack of knowledge of the market on the other side of the border, lack of networking opportunities, and the lack of a common method of international market entry.
   An evaluation of existing services and resources offered by industry associations was conducted, and combined with interview results. Recommendations for Grand Island to move forward with the project have been made. Although more research still needs to take place, it is evident now that Grand Island can take a leadership role by holding networking events, facilitating a web portal, and by co-hosting a bi-national roundtable discussion.

   Monday, May 15, 2006 . . .The Grand Island Town Board issued several proclamations during Monday night’s town board meeting.
   Supervisor Peter McMahon proclaimed May 25 and 26 as VFW Buddy Poppy Days and urged everyone to recognize the efforts of our service men and women by making a donation.
     Four Grand Island High School athletes were recognized for their outstanding achievements in their various sports. Recognized were Ian O’Rourke, diving; Tim Fargino, Track; John Connors, Track; and Jordan Stickl, Swimming. In their honor, the town board set aside May 15, 2006 as Ian O’Rourke, Tim Fargino, John Connors, and Jordan Stickl Day.
   In other town board news:
• No one spoke, either in favor or against, at the public hearing regarding improvements of consolidated sewer district and sanitary sewer district No. 5. Therefore, the board approved the increase and improvement of facilities of the consolidated sewer district and sanitary district No. 5 and also approved a bond resolution for the improvements
• The board approved a motion to authorize Granite Telecommunications to act as an agent to combine town phone accounts, at no cost to the town.
• Authorized the Town Supervisor, subject to approval from the town attorney, to sign and submit a grant application to the NYS Office of Parks, Recreation and Historic Preservation to replace playground equipment in the Ed Ball and Fairview Park playgrounds.
• A public hearing was set for Monday, June 5, 2006 at 8 p.m. to hear comments on the Final Plat Approval for The Golf Villas at River Oaks.
• A request to advertise for bids on the installation of a traffic signal at Baseline & Staley Roads was approved.
• One letter in favor and six letters opposed to the Gun Creek LLC reclassification from R1-D to PDD were referred to the town clerk for inclusion in the official Public Hearing record.
• Councilwoman Mary Cooke stated that the Grand Island Memorial Library is now the twelfth busiest in Erie County – a huge accomplishment.
• Councilman Gary Roesch reiterated that a chicken BBQ will be held on Saturday, May 20 from 2 to 7 p.m. to benefit Relay for Life. Tickets cost $8 and drive-up service will be available. All money raised will go to The American Cancer Society.
• Memorial Day Services will take place at 10 a.m. at DeGlopper Park.
• The town scheduled Thursday, June 8, 2006 as Assessment Grievance Day.

   Congresswoman Louise M. Slaughter, a Ranking Member of the House Rules Committee, joined Supervisor Peter A. McMahon and members of the Grand Island Town Board to celebrate a Grand Island sewer development project which has finally been initiated after over a decade of planning. Neighbors Speak Out Against Proposed Gun Creek Project - 2006

   Monday, May 1, 2006 . . .A plan for a residential mixed use development on 98.5 acres east of Stony Point and off Whitehaven Road was met with many concerns by residents during a public hearing Monday. Attorney Sean Hopkins, speaking for developer Jim Roll, described the project as a creative use of the land that when completed would have 41 estate lots, 52 family lots, 83 patio homes and 98 town houses designed around green space as a focal point. Wetlands would be preserved. The Planned Development District (PDD), if approved, would connect to Ransom and Stony Point roads with exits onto Whitehaven. Extra off street parking would take care of guests of patio homeowners. Though the open space is 20% (5% less than required for a PDD), Hopkins told the Planning Board to look at the quality of the open space rather than the quantity and admitted that with some adjustments the 25% could be achieved.
   But most of the residents attending the public hearing, except for 13 who stood in favor of the project, have major concerns and asked town officials why they weren’t sticking to the Master Plan and the resulting zoning map that is only two years old. Many pointed out that PDD zoning, while not part of this project, allows for commercial and industrial use that doesn’t fit the neighborhood.
   John Jones of Whitehaven Road warned that with so much development occurring Islandwide, the developer could end up with partial development of this project and resort to using it for commercial. Jones also mentioned that the project would compound traffic problems already existing on Whitehaven Road and said he often has trouble getting out of his driveway.
   Environmental concerns were also voiced, especially with Gun Creek running through the property and the existence of wetlands. Former Councilman Kevin Rustowicz and his wife Maura of Tracey Lane talked about wet yards and drainage issues and the lack of public utilities, requesting full SEQR on the project. They also had traffic concerns about the project increasing the traffic around the high school/middle school complex.
   Following the public hearing which resulted in the Town Board referring it back to the board for further study, residents and representatives of the developer met outside the court room to continue dialogue. Public comment will be accepted up until Monday, May 8.
   There were no comments during a second public hearing on whether to create Lighting District 47 in Grand Park Vue Estates, Phase 4, therefore, the board approved the request.




Decision On Certo Rezoning Delayed - 2006

   Monday, May 1, 2006 . . .Based on new information provided by Mary Wilson of Hennepin Road, the Town Board, Monday, referred Russ Certo’s rezoning request for his building at 1282 Stony Point from R1-E to R-3 back to the Town Board so they could address her issues with him. Wilson’s house is directly adjacent from Certo’s building that she claims already has apartments with renters. On the other side of her property is another home that owners have turned into a rental. She complained about noise, fighting, loud music, open drug use, lack of adequate window coverings, garbage and more. Photo boards of both properties were presented to prove that Certo’s property was taking on the look of an absentee landlord.
   Also speaking against the Certo rezoning were Peter Kuszczak and Doug Smith who both reiterated their opposition to spot zoning and asserted that Certo went ahead with converting the building to apartments without having the proper permits or zoning. Letters by neighbors opposing the rezoning were referred to as well as an article claiming that Certo said he had friends on the council.




Sidewalk For Bishops Gate/New England Village Underway - 2006

   Monday, May 1, 2006 . . . After years of discussion, the Town Board, Monday, approved (4-1) a bid from Broad Spectrum Concrete in the amount of $5,732 for construction of a sidewalk at Bishops Gate/New England Village at the rear of the high school parking lot. This allows for student walkers who live south of the school to avoid Ransom Road when exiting the high school/middle school complex. Safety was the main concern in driving this project agreed upon by the school and town. However, Councilman Gary Roesch, who has opposed the sidewalk from the start based on liability issues and maintenance costs, stood firm in his objection and voiced his concerns. According to the agreement with the school, it is the town’s responsibility to maintain the sidewalk (snow removal included).
   Supervisor Peter McMahon was authorized to sign a Memorandum of Understanding with the State Department of Transportation (DOT) for repaving and drainage improvements to the West River Service Road subject to the approval of the town attorney and town engineer. Under the agreement, the state would pay for the road repairs during this construction season. West River Homeowners had the following request: to have grass up to the driveways instead of a mixture of crushed stone that is meant to fill a two-inch drop off. That request will be forwarded to the DOT.
   A resolution requesting Erie County’s permission to proceed with the installation of a traffic signal at Staley and Baseline roads was approved. The cost is estimated to be $75,000 to $80,000 and the town agreed to finance the traffic light through issuance of serial bonds not to exceed $76,000.
   A public hearing has been set for Monday, May 16 to air proposed improvements to the Consolidated Sewer District and Sanitary Sewer District No. 5, specifically for sewers on Grand Island Blvd. It includes, but is not limited to, 550LF of 10-inch Gravity SDR Sanitary Sewer, 5550LF of 8-inch Gravity SDR Sanitary Sewer, 1600 feet of force main, 22 manholes, a 700GPM pump station and upgrades to pump station #17. The board also is looking to issue serial bonds in the amount of $1,135,625 to help finance the project, along with a quarter million dollar Federal grant, plus money in the wastewater budget and fees to residents benefiting from the sewers.
   In other business, the board:
• Appointed David Farmer and Tim Smith to the Parks & Recreation Advisory Board and agreed to advertise for residents to fill vacancies on other boards.
• Authorized the supervisor to sign the contract with J. O’Connell & Associates Grants Consultants for period May 7, 2006 to April 30, 2007 at a cost of $7,500.
• Announced the hiring of Robert Fraser ($12.50 per hour beginning May 15), Andy Burke ($9.50 per hour beginning June 5) and Lee Richards ($8.50 per hour beginning May 15) in the Highway Dept. as summer help.
• Approved the hiring of two seasonal full-time employees at $8.25 hour as summer help in the Water Dept.
• Accepted a bid from Leo Brenon Topsoil at a cost of $12 per yard and Podlucky Construction for concrete at a cost of $6 per sq. ft. for use in miscellaneous water/wastewater repairs.
• Upon approval of the town attorney, agreed to have Nextel Partners collocate on the existing cell tower at the water treatment plant.
• Approved a delay in re-paving part of the parking lot in the site plan for Hot to Go Racing at 2600 Grand Island Blvd. until Sept. 1, 2007.
• Authorized the supervisor to prepare, sign and submit a Justice Court Assistance Program Grant application for a security planning system that includes metal detectors, etc.




Town Board Salutes Golden Agers, Town Clerk - 2006

   Monday, May 1, 2006 . . .The Town Board, Monday, issued two proclamations citing May as Older Americans Month and designating April 30-May 6 as Town Clerks Week. Members of the Golden Age Club were on hand to lead in the Pledge of Allegiance and to accept the proclamation that praised the club for providing necessary services to senior citizens in the community since 1959.
   Deputy town clerks joined Town Clerk Pattie Frentzel who accepted a proclamation recognizing Town Clerks Week. The Town Clerk’s office, the oldest among all public offices, is the information center of local government and provides impartial and equal service to all citizens of the community.




Household Hazardous Waste Drop-off Day Set - 2006

    Erie County will hold a household hazardous drop-off day Saturday, May 13 from 9 a.m. to 2 p.m. at Erie County College North in Williamsville. Participants are to enter from Wehrle Drive. All waste must be household generated.
   Acceptable items for free disposal include oil-based paints (up to 10 gals.), pesticides (up to two gals. or 20 lbs.), solvents (up to two gals.), gasoline, motor oil, antifreeze, lead acid and rechargeable batteries, propane tanks and cylinders, and mercury.

   The Grand Island Town Board read a proclamation on Wednesday afternoon, May 3, 2006 to commend the school district on major accomplishments throughout the week.
   Newsweek named Grand Island High School as the 730th Best High School in the nation based on the number of students taking advanced placement exams.
   Business First has ranked the Veronica E. Connor Middle School as the 10th Best Middle School in Western New York.
   The School District Wednesday was notified that it is now ranked 12th, up from 16th, by Business First.

EDAB Announces "Medical Corridor Project" Presentation - 2006

   The Grand Island Economic Development Advisory Board (EDAB) has announced a special presentation on its new initiative, “The Medical Corridor Project," to be held 7:15 p.m. Thursday, May 18, 2006 in the Town Hall Court Room. The EDAB has been working with the UB School of Management on a joint program to evaluate cross-border opportunities for Life Sciences companies. This program is an important part of the EDAB’s initiative to promote Grand Island, NY as a destination for Life Sciences companies as well as other Canadian companies who are looking to establish a US presence. The work on this project has been conducted by two interns in UB's School of Management graduate program. They will be presenting their findings at the May 18th EDAB meeting. All who are interested in learning more about this project or about the EDAB Life Sciences initiative are invited to attend.

Town Adopts Resolution For Removal Of Toll Barriers - April 20, 2006 Meeting

   Monday, April 20, 2006 . . . A resolution calling for the removal of toll barriers at Williamsville, Depew, Lackawanna, Blasdell, Hamburg, Ogden Street, Black Rock and both the north and south Grand Island bridges was adopted, Monday, by the Town Board, and sent to appropriate government officials.
   Another resolution was presented to Mary Dunbar-Daluisio proclaiming May 1 as Paint the Town Purple Day in observance of Relay for Life that benefits the American Cancer Society.
   Local Law #4 was adopted Monday creating an enhanced environmental overlay district to protect Woods Creek in the area behind Eckerd Drugs to Veterans Park. The law is designed to carefully scrutinize any development that may impact the creek.
   Public hearings have been set for Monday, May 1 for creating a lighting district in Grand Vue Estates, Phase 4, and for preliminary approval of a Planned Development District using a variety of residential classifications in the Gun Creek project (98.5 acres currently zoned R-1D).
   A letter supporting a petition by residents on Baseline Road immediately adjacent to the NYS Thruway who wish to name the roadway servicing their homes "Old Baseline Road" was authorized for signing by the supervisor and will be sent to County Legislator Michele Iannello.
   It was announced that Deputy Town Clerk Karen Cooney would attend the NYS Town Clerk’s State Conference in Saratoga Springs April 29 with scholarship funds from the NYS Town Clerk’s Association. Scholarship money from the International Institute of Municipal Clerks will be used to send Town Clerk Pattie Frentzel to a weeklong program at Cornell University in July. Frentzel has applied and received $1125 in educational scholarship money since taking office.
   Part-time seasonal recreational attendants were approved for hiring as follows: Andrew Pappano, Theodore Rogers and Mark Larry beginning April 24; and Beverly Benton starting May 8.
   A change order for labor and materials to relocate an exhaust duct at the Master Lift Station, adding $2707 was approved for the Baseline Master Lift Force Main Replacement & Pump Station rehab project.
   DiDonato Associates was approved to receive $1,480 for costs associated in design work for the bidding document for the Staley and Baseline roads traffic signal.
   Upon recommendation of the Planning Board, the Town Board approved adding a pie shaped parcel of land, subdivided from Lot 60 in Park Place Subdivision upon approval by the town attorney. Preliminary approval of Meyer-Sheenwater Estates, Phase II on Love Road was tabled pending review of the project by the Conservation Commission.
   In other business the board:
• Appointed William Stanley as a Motor Equipment Operator in the Highway Dept.
• Awarded a bid for a new 2006 9 ft. all season dump body from STS Truck Equipment & Trailer Sales for $18,920.
• Agreed to re-bid a sidewalk project at Bishops Gate/New England Village.
• Approved a special use renewal from James and Irene Daigler for a pond at 2243 Staley Road.
• Approved advertising for a clerk-typist in the Parks & Recreation Dept., part-time at a rate of $8.98 per hour.
• Approved a revised site plan for Omni-Point co-location on the existing cell tower at 3078 Staley Road.
• Reminded residents that Senator Mark Coppola will be holding a town meeting at 2 p.m. Saturday, April 29 at Town Hall.




Neighbors Protest Patio Home Development - April 20, 2006 Meeting

   Monday, April 20, 2006 . . . Despite a lengthy explanation in defense of his project, John Stickl faced lots of neighborhood opposition to his request for rezoning 28.5 acres of land from R-1D to R-1E at the southwest corner of Fix and Baseline to develop a patio home subdivision of 78 lots. During the public hearing, Monday, Stickl said the request to downsize from 80x160 to 70x130 lot sizes was in keeping with the lot sizes in the surrounding area. Stickl came with concept plan, house drawings, wetland issue analyses, traffic statistics, market value surveys, soil studies and quoted the Town’s Comprehensive Plan to make a case for his proposal. He cited a need for this type of development for empty nesters who want to downsize to a smaller single family home rather than a town house.
   Attorney Rich Lippes, speaking on behalf of the homeowners in the area (Fareway, Baseline & Fix), said the public hearing was premature and without an Environmental Impact Statement, the proposal was moot. He quoted the law, stating that State Environmental Quality Review (SEQR) has to be done before any concept plan can be considered. He cited huge state wetlands that might be affected and the creek running through the project as major environmental issues that need to be addressed prior to any development of the land.
   Using the Comprehensive Plan for his argument, Lippes said high density development of patio homes was planned for high density areas such as the center of town and in R-2 zoning. Presently there is only one ring of homes around the area being considered plus lots of farmland that could scarcely be considered high density. Further he argued against two of Stickl’s assumptions. One, that only empty nesters would be buying the homes taking into consideration that they could function as starter family homes as well. And two, that property values are not based on the cost of homes alone. Loss of green space and future build out certainly affects property values.
   Lois Shriver, an Amherst resident and friend of neighbors opposing the project, objected to the retention pond planned for the middle of the development that would be unfenced, said there were no sidewalks on Fix or Baseline for seniors to walk on, and felt the project was not compatible with existing development. She cited extensive soil problems and suggested that the same problems that Amherst is having with sinking homes might occur here.
   Liz Lutnick, Frank Burkhart and Roger Cook all objected to indiscriminate changes in the zoning especially since such care, time and effort were put into creating the Town’s Comprehensive Master Plan. Lutnick said Stickl bought the R1-D land and should utilize within those zoning restrictions.
   A petition was presented by Tom McAuliffe from residents on Fareway Lane who desperately want to keep traffic from the proposed development out of their area by maintaining the cul-de-sac. Others voiced concerns about additional traffic problems, citing too many accidents already occurring at Fix and Baseline.
   The Town Board entered into the record two other objections to the project that were sent by e-mail before closing the hearing and referring the issue back to the Town Board for further review.

Town of Grand Island Receives Anonymous Cash Donation - April 2006

   Friday, April 14, 2006 . . .The Town of Grand Island received an anonymous cash donation on Thursday, April 13, 2006. According to Supervisor Peter A. McMahon, an envelope with a $10 bill in it, also included a note telling the supervisor to put the money into the "doughnut fund."
   "We don't have a doughnut fund but we have a coffee fund so I'm going to put it there," the supervisor said this morning. "At this rate, it's going to take a long time for Grand Island to catch up to Amherst but we're only $4,990 short," he said.
   The Buffalo News reported yesterday that $100 bills totalling $5000 were mailed to Amherst Supervisor Satish B. Mohan last week with a note of support for Mohan. The same article stated that Supervisor McMahon would be checking his mail more carefully!

ECIDA To Pursue Grant Money To Salvage Dunlop Building - April 2006

   April 11, 2006 . . .Erie County Industrial Development Agency, Monday, announced that it would pursue a grant of up to $100,000 from the state's Build Now-NY program to salvage the Dunlop building on Grand Island Blvd. along with the 144 acres of land surrounding it.

"This grant application is the result of a concentrated effort on the part of a number of people who are working to resolve the issues associated with the former Dunlop Building. The grant application, filed by E.C.I.D.A., requires a $100,000 match. This money will come from a private developer who is interested in making an investment in commercial development in the neighborhood. If we are successful in getting the grant, there will be a total of $200,000 available to develop a plan to convert the building to a useful condition or to demolish it so that the land can be used for some other commercial economic development projects.
   I can't imagine anything we could do that would improve the image of Grand Island than to convert this building to a productive use."

Deadline Approaching For Star And Senior Star Exemptions - 2006

   May 1, 2006 is the cutoff date for all Basic Star, Enhanced Star/Senior Exemption and Veterans tax exemptions to be added to the assessment roll for School Tax year 2006/2007, and Town/County Tax year 2007. Those who have not already done so, are asked to bring their paperwork to the Assessors Office at Town Hall on or before Monday, May 1, 2006.




Town Board Action - April 3, 2006 Meeting

   Monday, April 3, 2006 . . .A proposed local law amending the jurisdiction of the Architectural Review Board was referred back to the Town Board Monday for further review. Proposed is eliminating the need for single family home permits to be approved by the Architectural Review Board with the exception of specific instances. The Board will address only commercial permits. No one spoke on the subject, but an e-mail from Tim Morrell will go into the record.
   A public hearing was set for April 17 at 8 p.m. to consider rezoning 28.5 acres at the southwest corner of Fix and Baseline roads from R1-D to R-E.
   The board appointed Dan Stinson to the Community Enrichment Advisory Board for the balance of a one-year term expiring December 31, 2006.
   Approval was given Supervisor Peter McMahon to sign onto a contract for participation in the New York Power Authority Relicensing Consortium. Grand Island would join the City of North Tonawanda in seeking the NYPA to increase capacity to generate more clean renewable power so that the Niagara Project will generate a larger pool of revenue that can be used to minimize impacts to the host communities. Also sought is a request for larger power allocation and evaluation of impacts on the communities’ tax base given that these projects are exempt from local taxes.
   The supervisor was given approval to sign the water/wastewater service contracts with the state for Beaver Island State Park.
   Summer part-time seasonal hires were approved for the Recreation Department as follows: Maintenance (Michael Cole, Thomas Digati, Kyle Moody, Kevin Kloesz who start April 4; and George Christensen, Clifford Smith, G. Cody Clarke, Shaun Quinn and Mark Larry who begin April 17.
   A change order regarding the installation of water meters resulted in a net decrease to the contract of $25,385.
   Referred back to the Town Board and Town Attorney was a letter from William Costello II, Esq. regarding a request to transfer property at 2307 Bedell Road from Donald Loder to Hanz Sterzelbach. Also referred back to the Town Board, Planning Board and Zoning Officer is a request by Cheryl Stolzenberg to merge front and back properties at 3077 Love Road and then subdivide the property.
   The Town Board suspended the rules to consider a request from URS for additional compensation to complete work necessary to finalize revisions to the Local Waterfront Revitalization Plan. Approved was $2600 for mapping changes.

Neighbors Up In Arms Over Stony Point Rezoning - 2006

   Monday, April 3, 2006 . . .Despite a draft of restrictive covenants drawn up by the Town Board specific to the request of Russell Certo to rezone property at 1282 Stony Point from R1-E to R-3, neighbors voiced their objections Monday during a public hearing.
   Doug Smith, who has been vocal about the downgrading of the rezoning on many occasions, asserted that he sees it as a done deal and claims work is being done to convert the building to apartments day and night. He reiterated that he has indulged Certo’s folly for well over 20 years and that the building should conform to the neighborhood as a single family home. Peter Kuszczak referred to the long history of problems with the property and said dangerous precedents would be set with regard to future ownership of the property by permitting this rezoning. Henry Carroll wondered why the town wasn’t adhering to the new town zoning map that was approved at considerable cost and why the Town Board wasn’t following the Zoning Board’s recommendation to deny rezoning.
   A few spoke in favor of the rezoning including John Tripi Jr. who would be doing the renovation for Certo. He said to remove commercial business from the residential area would be more in character with the neighborhood. Kathleen Carbonati said she didn’t mind the building being converted to apartments as long as there was a privacy fence and the area was cleaned up.
   Covenants to the rezoning being considered by the Town Board are:
1. Limiting the property to residential apartment use.
2. Limiting the apartment number to three.
3. Not permitting any expansion of the one-story/professional office structure and that any remodeling, renovation, modification or repair be contained within the perimeter of the building.
4. Denying any expanded parking area on the Hennepin Road frontage.
5. Reducing parking area on Love Road frontage to a maximum of eight parking spaces.
6. No zoning variance or special exception granted by any municipal authority shall be construed as an amendment to this Declaration.
7. Any construction, modeling, renovation, modification or repair of the structure be in full compliance with any and all zoning regulations and any and all building codes.
8. The invalidation of any part of this Declaration by any court having competent jurisdiction shall in no way affect any of the other provisions herein, which shall remain in full force and effect.
9. Failure on the part of any party to insist upon immediate compliance with any of the reservations, restrictions or covenants created herein shall not be deemed a waiver thereof.
10. This agreement shall be binding upon and shall inure to the benefit of the parties and their respective heirs, successors and assigns and shall run with the land.
   Following the public hearing, the Town Board referred the matter back to the Town Board for further consideration.

Town Seeks Volunteers For Clean Up 2006 - 2006

   In March, Keep America Beautiful, Inc. kicked off its annual Great American Clean Up™ campaign for 2006. Run locally by Keep Western New York Beautiful, this is the nation’s largest community improvement program, with millions of residents across the country volunteering.
   The Town of Grand Island will participate in the campaign Saturday, June 24, 2006 from 9-11 a.m., with a litter removal along Grand Island Boulevard. Volunteers are asked to assemble at Town Hall where supplies for the clean up will be provided. For additional information, contact any member of the Grand Island Town Board.

Residents Raise Concerns Over Amendments To Zoning Code - 2006

   Monday, March 20, 2006 . . .Residents packed the court house at Monday night’s town board meeting to speak against amendments to the current zoning code. One provision can restrict residents from parking commercial or recreational vehicles weighing over 18,000 pounds on their front or side lots. Before hearing public comments, the board noted that section 49.49 which details the parking restriction will be removed so that the rest of Local Law Intro #3 may be passed. Councilwoman Mary Cooke stated that several issues have been brought to the board’s attention, and acknowledged that there are problems to be addressed. The board plans to review and resolve section 49.49 and hold another public hearing on the issue before action is taken. In the meantime, residents are concerned.
   Robert Mesmer of Love Road believes the problem can be fixed by enforcing current laws. “It’s not as clear as it could be,” he said. Bedell Road resident Bob Soluri, who owns a 35-foot RV raised concerns over the code’s enforcement. “Would it be up to the police or the zoning officer?" Soluri said, “if you pass the law, I’m still going to park at home, so I’ll see you in court every week.”
   Similar concerns were raised by Island resident Terry Freiermuth who said that the zoning inspector can interpret the “broad definition of a commercial vehicle” however he sees fit. He also questioned whether advertising or signage on vehicles could classify any vehicle as commercial, therefore preventing many people from parking their daily vehicle at home. Supervisor Peter A. McMahon answered that weight, not advertising, is the issue. He stressed that no vehicle under 18,000 pounds, whether there’s an advertisement on it or not, will be affected by the zoning amendment. Freiermuth urged the board to clarify the definition of a commercial vehicle to prevent future misinterpretation.
   Resident David Williams echoed Freiermuth’s opinion stating that the zoning amendment is very confusing the way it is written. “Many residents don’t even know this is going on,” said Dan Drexelius of Whitehaven Road. He, too, is concerned over the code’s language and believes the way it is written lends itself to misinterpretation. He suggested that the board limit the specifics of the language, but said the amendment will still not solve the obstruction issue. “Some big rigs are not 18,000 pounds, but they’re still an obstruction.” He suggested that the new zoning be applied differently according to the size of property.
   Others believe there should be more exceptions to the rule. “If you have a lot of land, you should be able to park,” at least according to Richard Reimers. Reimers said that people pay hundreds of thousands of dollars to purchase RVs and should be able to park them at home where they’re protected. “There are a lot of junk cars out there that look a lot worse than motor homes.”
   Resident John Tripi, Jr. raised questions pertaining to the parking of construction equipment on private property. Supervisor McMahon again stated that as long as the equipment was not parked in side or front yards, it’s not a problem. The amendment will restrict the overnight parking of construction trailers in the street. Isle resident Norm Walck suggested that the board “eliminate the side yard language” completely since side yards are less of a view obstruction. The board will announce a new public hearing after revisions to section 49.49 have been made.

Public Hearing On Zoning Changes Rescheduled - 2006

   Monday, March 6, 2006 . . .Due to problems with the legal notice on the public hearing for zoning changes, the hearing, originally scheduled for March 6, will be held March 20 at 8 p.m. To be considered are changes regarding contiguous parcels of land, provisions for applying for a Tower Permit, changes to agricultural uses such as general farming and Christmas or nursery tree farming. Also definitions of shoreline and riverside lots and building regulations, permitting Houses of Worship as a permitted use in the B1 District and definitions and parking restrictions on commercial vehicles. (see complete proposed amendment changes in "Jan. 17 Town Board Story").
   Two other public hearings will take place March 20. One will concern a local law creating an Enhanced Environmental Overlay District from Grand Island Blvd. to the Library. The Planning Board has recommended the grandfathering of existing structures along the creek route. Another public hearing will air pros and cons of rezoning the southwest corner of East River Road and Whitehaven Road.
   Local Law #1 limiting the number of dogs to three before a kennel license is required was adopted, Monday, following a public hearing at which no one spoke for or against. Also granted, as a result of a public hearing, was final plat approval for Hidden Oaks Phase 3. Jim Dinsmore spoke in favor of the project saying that completion of the development would tie Oakridge Road into Baseline.
   Personnel in the Assessor’s office was increased with the appointment of Judy Tafelski as Assistant Assessor (Grade 6) effective Monday, March 13. Due to this increased help, Assessor Dave Unmack reduced his request for additional contracted appraisal services from 50 to 30 hours at a cost of $40 per hour.
   The Town Board adopted the use of the National Incident Management System (NIMS) which is required by September 2006 to be eligible for federal funding. Projects that could be impacted by not being in compliance would be any Community Development Block Grants, Buckhorn Bike Trail and the Grand Island Blvd. sewer extension.
   Due to recent state legislation regarding tax collection, the Town Board passed a local resolution to accept partial payments in any amount for taxes effective March 7.
   Adopted as presented were updated Recreation & Parks Advisory Board By-laws. Since there are vacancies on the board, Supervisor Peter McMahon said the Town would advertise for positions to the Rec. Board. Those wishing to serve should send letters of interest to McMahon at the Town Hall.
   In other business, the board:
• Awarded the liquid sludge hauling bid to J.A. Brundage (The Drain Doctor) at a cost of $0.020 per gallon.
• Authorized the supervisor to sign a contract with Allen Marine Services for inspection/cleaning of the raw water intake pipe at a cost of $11,400.
• Extended the date for completion of landscaping at the Carl Road Lift Station till June 1 at no additional cost to the contract.
• Referred to the town attorney a five-year contract with Ferguson Electric for a preventive maintenance program for the water treatment plant and water storage plant.
• Approved tower permit renewals with Global Acquisitions II LLC for towers at 318 Baseline (water plant) and 3078 Staley Road.
• Granted Connie Farugia and Julian Archie exception to subdivision regulations to create a 300x1045 ft. lot out of an existing 126 acre parcel for the building of a house on Alt Blvd.
• Granted site plan approval for a 3,000 sq. ft. addition and temporary offices (no mobile homes) at APP Pharmaceutical on Staley Road.
• Granted site plan approval to George DeGlopper at 2449 Whitehaven Road for construction of a storage building.
• Referred to the Town Board a residency preference provision proposal from Erie County Personnel Dept.
• Referred to the Town Board a letter from Anna Kapus proposing Alvin Road be renamed Fuccillo Drive.

Residents Air Concerns On Proposed Campground - 2006

   Monday, February 6, 2006 . . .Despite several people testifying to the integrity and good intentions of four partners who want to open a quality and environmentally friendly campground on 70 acres of land on Whitehaven Road, there were plenty of neighbors who questioned whether the project was viable. The public hearing on the campground and mining overlay district to accommodate a seven-acre lake is the first step in the project that still must undergo a state environmental review. The DEC, according to Supervisor Peter McMahon, may even seek lead agency status and there are wetlands issues to be addressed.
   Explaining that the campground would be nothing like KOA, Larry Stolzenburg, Elaine Pariso, and Tom McLaughlin described a park-like setting with lake, boating, hiking trails, a log lodge with a store, nature center, pool and chapel. In the off-season, the partners suggested the campground could be open to Island residents for cross country skiing and ice skating. The fourth partner, Don Benoit, who recently planned a fishing campground in Alaska, was not present but engineers made themselves available after the public hearing to answer neighbors' questions.
   Among those citing concerns was Ed Szpala, an adjacent neighbor, who said no attempt was made from the partners to announce the project to surrounding residents, and he’s worried about infrastructure issues, mainly the condition of Whitehaven Road, potable water service and power supply to the campground. Mark Danahy wondered what the condition of the road would be after trucking off the clay for the lake – estimated at 18 to 20 truck trips a day for many months. Richard and Florence Myers, who have lived on Whitehaven Road for 30 years cited safety concerns since Whitehaven Road does not have a shoulder to bike or jog upon. Questions about the price of clay with the excavation of the lake, the possible stagnation of the lake and whether that was the main purpose for the project also were voiced. Andrea Mondich said she worries about the safety of children and the already heavy boat traffic heading to the River Oaks Marina during the summer months. Ken Johnson advocated for a pedestrian trail from Whitehaven to the center of town and reduced speed limits on the road from 45 to 30.
   But Frank Burkhart who has been a critic of several development projects, supports Elaine and Don and feel they will be responsive to concerns raised. He asked that their ideas be heard and was convinced any project of theirs would be in harmony with nature. Bob and Barbara Fike, who bought a residential lot bordering the proposed campground, had no worries and said Grand Island should be supporting this kind of development to enhance the businesses here. All comments were referred back to the Town Board for review.
   A public hearing regarding preliminary plat approval for Grand Park Vue – Section 5 (20 lots) was granted. The developer, John Stickl, was on hand to explain Phase 5 and no one spoke in opposition.
   Cancelled was a third public hearing on a modified plan regarding preliminary plat approval for New England Estates, due to a withdrawal of the request by the developer.
   Opening the meeting was a proclamation congratulating Invitrogen for sponsoring the 5K run/walk Saturday, May 13 that will benefit Make-A-Wish and the Make-A-Wish Foundation.
   Change orders for two projects were approved. An additional $4,620 will be spent to replace downspouts, make repairs to a deteriorated portion of soffit, and to furnish and install snow guards over the entrance vestibules as part of the Golden Age Center roof replacement project. The funds are available in the original budget because project bid results were lower than anticipated.
   In updating the town’s facilities, an additional $23,690 will be spent for time and material in the removal of chart recorders and replacing them with a wall monitor while adding an additional 12 control I/O points to the SCADA system in the Water Department. Another $23,750 will provide for integrating pumps 3, 4, 5, and 6 into the SCADA system. These funds will be taken out of the contingency monies in the performance contract.
   In personnel issues, there was a motion to create the position of Assistant Assessor and the supervisor was given the green light to sign and submit the PO-17 forms outlining the duties of the new position.
   The board waived a rezoning fee for the southwest corner of Whitehaven and East River due to the fact the rezoning was supposed to be handled during the town-wide rezoning in 2005. Involved is the realignment of a section of property owned by Niagara Development Group from a north-south axis to an east-west axis.
   In other business, the board:
• Re-approved map covers for Fairway Greens Phase II – Cluster 19
• Announced that Congresswoman Louise Slaughter will hold a town meeting in Town Hall Saturday, February 11 from 2:30-3:30 p.m.
• Referred to the Town Board an open letter to the residents of Erie County from the Erie County Fiscal Stability Authority that addresses positive fiscal actions to reduce the cost of government to taxpayers through shared services. It calls for business leaders and all levels of government to meet the collaborative challenge.
• Tabled By-laws presented for the Recreation & Parks Advisory Board.
• Appointed Kyle J. Greene of East River Road to the Cable/Communication Committee for a three-year term expiring in 2008.
• Set a public hearing for 8 p.m. Monday, March 6 regarding final plat approval of Hidden Oaks Subdivision – Phase 3 (24 lots).
• Approved a site plan modification to permit an increase in the height of the communications tower from 75 to 120 ft. at the Homeland Security Building on Lang Blvd.




Revised Smoking Policy For Town Employees Adopted - 2006

   Monday, February 6, 2006 . . . A revised policy dealing with smoking in town-owned buildings and vehicles was adopted Monday. It is consistent with NYS Health law.
   Smoking is not permitted inside any town-owned building (including but not limited to restrooms, break areas, common rooms, etc.) and town vehicles. "No Smoking" signs shall be prominently posted in these areas. This pertains to customers and visitors who will be advised of the policy in a diplomatic and non-confrontational manner.
   Responsibility for adherence is the supervisor or department head and the policy must be strictly enforced. Employees may smoke outside of town buildings, but only in areas designated by management and only during designated meal and break periods.
   Those in violation of the policy will be subject to appropriate disciplinary action subject to the terms of applicable collective bargaining agreements.

    Town Clerk Patricia Frentzel announced that the 2006 Town/County Tax Bills have been mailed. If you have changed banks, have paid off your mortgage or do not have an escrow account and did not receive a tax bill, please contact the Town Clerk’s office at 773-9600 ext. 620 or 600. The office will be open extras hours as follows:

Proposed Local Laws Affecting Zoning Referred To Planning Board - 2006

   Tuesday, January 17, 2006 . . . Several amendments to the Town’s Zoning Code were submitted to the Planning Board for review and recommendation during Tuesday’s Town Board meeting. The following highlights the changes:
• Section I (49-14) Contiguous parcels: When two or more parcels of land, both or one of which lacks adequate area and dimension to qualify for a permitted use under the requirements of the use district in which they are located, are contiguous and are held under one ownership, they may be approved for such use as long as the lots shall be combined on the zoning map and tax map and deeded as one lot.
• Section 3 (49-147-1): Commercial vehicles: No truck shall be parked or stored outside of a completely enclosed building in a residential district, except while loading or unloading or being used to perform a service on the premises. No construction machinery shall be parked overnight in a residential district unless such machinery is incidental to construction activity occurring on the premises. Definitions of agricultural vehicle and equipment, commercial vehicles and construction vehicles, personal recreation vehicles and parking rules regarding the above have been redefined.
• Section 4 (49-47) Principal Uses: Principal Uses and structures permitted in the R-1D District, except Bed and Breakfast.
• Section 5 (49-199-J): Tower Permit: At the time of obtaining a tower permit, the applicant must provide a financial security bond with the town in an amount fixed by the Town Board but not less than $10,000.
• Section 10 thru 12) Definitions of Shoreline lots and Riverside lots have been amended. Shoreline lot means the portion of a riverside lot actually adjoining the Niagara River. Riverside lot is any lot which borders the Niagara River. For purposes of setback and building coverage calculations, such lots will be deemed to end at the top of the river bank or at the normal high-water mark. Where a riverside lot is in common ownership with an adjoining lot separated by a right-of-way (even if covered by more than one deed), and the lot is too small to permit construction of a principal use without a variance, both such lots shall be considered riverside lots for purposes of this code, except that the provisions will not apply to the non-shoreline lot portion.
• Structures other than riverside accessory uses on shoreline lots shall be no closer to the river shoreline (measured at the top of the bank) than:
   1. where there are already two principal structures on adjoining lots, no closer than the average distance of the two adjoining principal structures to the river shoreline, but no less than the rear yard for the district.
   2. Where there is a principal structure on only one adjoining lot, no closer than that principal structure to the river shoreline, but no less than the rear yard for the district.
   3. Where there are no principal structures on adjoining lots, but no less than the rear yard for the district.
   4. Riverside accessory uses and structures on shoreline lots such as pools or other structures less than four feet high, and which do not obstruct the views of the river may be placed in the rear yard of a shoreline lot. Fences in rear yards of shoreline lots shall not be opaque and shall not exceed four feet in height.
• Under Section 13 (49-10) Exemptions – A recreational pond not greater than one-third of an acre or 10 percent of total lot in total surface area, whichever is lesser, on a lot of not less than two acres, with setbacks of at least 50 feet from any front, side or rear line, and slopes no greater than one foot vertical to three foot horizontal for any bank continuous to the toe of the slope. Recreational ponds qualifying for this exemption shall obtain a building permit and Chapter 15 Grading Permit.
   Another proposal to Town Zoning Map is to rezone the land at the southwest corner of East River Road and Whitehaven Road from B-1 and R-2 to B-1 and R-2, so that the B-1 zone shall extend 1,300 feet easterly from East River Road along Whitehaven Road, 645.93 feet southerly from Whitehaven along East River Road, and the property currently zoned B-1, not in the above description, be rezoned to R-2.
   A local law to place the land lying 100 feet on each side of the center point of Woods Creek between Grand Island Boulevard and Bedell Road in an Enhanced Environmental Overlay District is also be considered.




Zoning Report Received For 2005 - 2006

   Tuesday, January 17, 2006 . . . The Town Board, Tuesday, accepted and filed the activity report for the Zoning Department over the past 12 months.
   Correspondence from the Zoning Office in 2005 included 147 first notices for unlicensed vehicles, 48 final notices for unlicensed vehicles, 32 letters regarding miscellaneous infractions, 32 for refrigerators, 30 for litter and dumping, six for signs, 11 for vehicles parked on lawns, three for fences and one for a trailer.
   Pending matters as a result of correspondence resulted in 30 unresolved first notices for unlicensed vehicles, nine final notices for unlicensed vehicles, eight for miscellaneous, one final for litter and dumping, six for refrigerators.
   The Zoning Board of Appeals over the past year heard 71 new cases. Building permits have been issued for 15 permanent signs, location permits for 90 fences and 74 sheds, 18 permits for temporary signs.
   Written responses were given for 32 complaints and to date there have been 22 agricultural permits issued.
   Chapter 49 code books are being compiled which are sold by the Town Clerk at a cost of $25. Each book includes a zoning map.
   Eight Zoning Code Compliance letters were written to lending institutions and lawyers.




Public Hearings Set For Feb. 6 - 2006

   Tuesday, January 17, 2006 . . . The Town Board, Tuesday, set public hearings for February 6 at 8 p.m. on three development projects before the town. To be considered is preliminary plat approval for Grand Park Vue – Section 5 which consists of 20 lots in an R-1D zoning district. It is an extension of Pin Oak Circle with a temporary turn-around. A modified preliminary plat plan for New England Estates will also be aired. The revised plan includes the addition of a lot after the town eliminated the Inner Loop Road. The third involves site plan approval for a campground and mining overlay district on Whitehaven Road that will include a pond, lodge and three locations for toilet facilities.
   A rezoning request from John Stickl for 28.5 acres southwest of Fix and Baseline roads was tabled pending SEQR and referred to the Town Board. Stickl is seeking an R-1E classification instead of the existing R-1D to accommodate 1,500 to 1,800 sq. ft. ranch homes with a homeowners' association to control densities.
   Referred to the Town Board and Town Engineer was a request from Town Clerk Patricia Frentzel to re-align election districts. The review and realignment of election districts is needed because in at least five of the districts the town exceeds the legal limit of 950 registrants.
   The Town Board rescinded on an emergency basis a sludge hauling contract with John Brundage (The Drain Doctor) due to the fact Brundage did not have the required tank truck vehicle with 4,000 gallon capacity. While negotiations continue, Ball Toilet & Septic Systems is handling the sludge hauling.
   Two change orders were approved regarding the performance service contract. One involves a credit for the Owner’s Protective Liability Insurance with a net decrease to the contract in the amount of $1,500. The other is to provide labor, material and supervision for the completion of a reactor tank sludge removal at the Wastewater Treatment Plant resulting in an additional cost of $38,446. The net increases will be taken out of the contingency monies in the performance contract.
   Speaking from the floor, Dean Duguay of Staley Road presented a letter of complaint regarding alleged abusive treatment by Doug Learman and called for a large scale investigation by an independent group of Learman’s actions over the years as Building Inspector.
   In other business, the board:
• Authorized payments totaling $3,255.70 to town employees who incorrectly filled out their sell-back forms last fall by entering the number of days instead of the number of hours.
• Received and filed the Parks & Recreation Annual Report for 2005.
• Referred to the Traffic Safety & Advisory Board a request from Highway Superintendent Ray Dlugokinski to install a stop sign at the northwest corner of Birkshire at Pin Oak Circle.
• Accepted with regret the resignation of James Harmaty, water treatment plant operator for 36 years.
• Referred to the Town Board a request from Parkland Enterprises attorneys for a six-month building permit extension for the convenience store at the corner of Ransom Road and Stony Point roads due to construction delays and ongoing negotiations with the vendor who will be occupying and operating the store.

Passport Applications Accepted At Town Clerk's Office - January 16, 2006

   Effective today, January 4, 2006, the Grand Island Town Clerk's office will accept applications for Passports. According to legislation
(www.travel.state.gov) it will be required for all residents traveling within the Western Hemisphere to carry a passport or other accepted documents by January 1, 2008. Residents will not be required to have an appointment, however the acceptance hours in the Town Clerk’s office will be:
Monday – Friday - 9 a.m. to – 12 p.m. -and- 1-4 p.m.
   If an appointment is necessary, residents may contact the Town Clerk (716) 773-9600 ext. 600.

Shared Services Grant Sought - 2006

   Tuesday, January 3, 2006 . . .The Town Board suspended rules Tuesday to authorize Supervisor Peter McMahon to sign a shared services grant application, not to exceed $100,000, to fund a feasibility study that would explore sharing municipal services with the Grand Island Schools.
   The supervisor was also authorized to sign the agreement to provide administrative services for the Retiree Drug Subsidy Program between Blue Cross/Blue Shield and the Town. McMahon was directed to sign a NYS Hazard Abatement Board Occupational Safety & Health grant request that would provide safety and health training to hourly town employees.
   The Town passed a budget amendment to add $7500 to recreation for the repair and maintenance of Kaegebein Tennis Courts. An additional $2500 will be added to that effort as part of a Tennis in the Parks funding from the US Tennis Association that was awarded to the town.
   Bids will be open on Wednesday, January 25 at 10 a.m. for the purchase of replacement pumps for the Return Activated Sludge (RAS) Pumps and the Scum Pumps at the Wastewater Treatment Plant. A total of three RAS pumps and two Scum pumps will be purchased.
   Councilwoman Mary Cooke announced she was returning a health insurance refund check in the amount of $2445.43 to the town and urged other elected officials to do the same. The check is the result of an incentive policy for employees who do not take coverage through the town thus saving the town money. However, Cooke believes health insurance benefits offered by employers are not intended to be a source of income.

   Tuesday, January 3, 2006 . . .Supervisor Peter McMahon again named Dick Crawford Jr. as his deputy supervisor during the town’s reorganization meeting held Tuesday, January 3. It was Sue Argy’s first meeting as councilwoman and she was welcomed by other members of the board. McMahon asked for and was granted a 60-day extension for filing the Supervisor’s Financial Report for the fiscal year 2005. He also appointed Elizabeth Zilbauer as his secretary for the new year.
   The town board adopted a resolution that declared all operation and maintenance costs and all capital costs, net of water rents and other revenues, would be apportioned against the assessed land valuation of each of the properties or parcels of land within the Consolidated Water District.
   The town board also took action on the following:
• Set mileage at 44.5 cents per mile for town officials performing duties for the town.
• Authorized membership at the NYS Association of Towns Meeting in New York City by those department heads and/or elected officials with necessary funds in the budget; and authorized the supervisor to cast one vote for the town at the meeting. Gary Roesch, who plans to attend, was named alternate delegate.
• Renewed the town’s membership in the Association of Erie County Governments and the Association of Towns of New York State.
• Set petty cash funds as follows – town clerk ($700), sewer and water ($150), town justices ($200), highway dept. ($125), recreation dept. ($100), Enrichment & Referral ($100).
• Announced town clerk’s office hours as 8:30 a.m.-5 p.m. Jan. 1-June 30 and Sept. 1-Dec. 31; 8:30 a.m.-4:30 p.m. July 1-Aug. 31; closed on town designated holidays; special hours for tax collection to be announced. The Grand Island Town Clerk’s office will be open an additional hour (until 6:00 p.m.) each Wednesday through July 1st.
• Set bond amounts for town personnel – supervisor ($250,000), town clerk ($250,000), deputy town clerks ($250,000), supervising accountant ($250,000), court clerks – town justices ($100,000), and a blanket bond for each other bonded employee ($5000).
• Designated the Island Dispatch as the official newspaper for the town.
• Designated M&T Trust Company, HSBC Bank, MBIA CLASS, JP Morgan Chase Manhattan Bank, Citizens Bank, First Niagara Commercial Bank and Bank of America as depositories for the town.
• Named Bonadio Group as audit counselors.
• Set town board meetings for the first and third Mondays of each month at 8 p.m. unless it falls on a holiday in which case it will be held on Tuesday. Workshops will precede the meetings at 6:30 p.m. There is no meeting the third Monday in February due to the Association of Towns conference.
• Designated Supervisor Peter McMahon as budget officer for the town, and as police commissioner and town liaison for the Grand Island Police Dept.
• Agreed to retain the law firm of Hodgson, Russ, Andrews, Woods & Goodyear LLP, Peter C. Godfrey, Esq. Of Counsel as attorneys for the town.
• Authorized the supervisor’s renewed membership in NYS Government Finance Officers Assoc., New York Planning Federation and State Association of Municipal Purchasing Officers.
• Adopted an investment and procurement policy and adopted a fee schedule for 2005.

Martin Luther King Day (Monday, Jan. 16), President’s Day (Monday, Feb. 20), Good Friday (1/2 day Friday, Apr. 14), Memorial Day (Monday, May 29), Independence Day (Tuesday, July 4), Labor Day (Monday, Sept. 4), Columbus Day (Monday, Oct. 9), Veterans Day (Thursday, Nov. 10), Thanksgiving and day after (Thursday & Friday, Nov. 23-24), Christmas Eve (Friday, Dec. 22 & Christmas Day, (Monday Dec. 25), New Year’s (1/2 day Friday, Dec. 29) and (Monday, Jan. 1).

   Town Justice Hon. Sybil Kennedy officially installed two Grand Island councilwomen, a town justice and highway superintendent on January 1, 2006 in the Grand Island Golden Age Center on Whitehaven Road. Installed were Councilwoman Mary Cooke who won a fourth term on the town board Tuesday, November 8, 2005; Susan J. Argy also elected to the town council; Mark J. Frentzel, elected Town Justice; and Raymond Dlugokinski, re-elected as highway superintendent for a third term. A reception followed the noon inauguration.
