Public Hearing - January 4, 2007

   For the purpose of hearing objections to or for the granting of appeals, the Zoning Board of Appeals will hold the following public hearing on Thursday, January 4, 2007 at 7 p.m. in the Town Hall. The following variance will be considered:
• Sandy Beach Yacht Club, for the construction of an addition 20' x 24' to existing clubhouse with less side yard set back at 1851 Winter Road

Water Rents Set, Discounts For Blvd. Sewer Tap-ins - December 2006

   Monday, December 18, 2006 . . .The Town Board, Monday, set water rates at $2.70 per 1,000 gallons and wastewater rate at $4.40 per 1,000 gallons. On recommendation from the Special Districts Committee, the Board also decided to offer reduced tap-in fees for the newly constructed sewer line on Grand Island Blvd. Tap-ins will be permitted at 10 percent of the normal fee through June 30, 2007.
   The Board also acted on the Special Districts recommendation to insist on the use of copper connections from the water main to the curb, but allowing the use of PVC and HDPE elsewhere. Also from Special Districts, an amendment in the 2006 fee schedule was approved as follows: current sewer tap fees be deleted for both duplex or apartment buildings and hotels, motels and nursing home and new fees would be based on size of waterline serving the building (.75” and 1” - $450 per tap, 1.5” & 2” - $550 per tap, over 2” $650 per tap). Tap-in fee for single dwellings would be $450.
   Approved was the additional payment of $9,480 to URS to cover construction inspection for the Grand Island Blvd. sanitary sewer.
   A public hearing on a proposal to rezone a two-acre parcel on East River Road from R-2 to R1-D from the Niagara Development Group was referred to the Town Board for further review and SEQR. Al Hopkins, the engineer for the Group, explained that the land in question was originally zoned R-3 and later B-1. During the latest Master Plan process it was converted to R-2. However, because the land has a million-dollar view of the river, Niagara Development Group seeks to build seven traditional homes on 80x160 lots and thinks this is in keeping with the character of the property. The Planning Board recommends the Board deny the request because it would be considered spot zoning in lieu of the fact the adjacent properties are zoned R1-C.
   Referred to the Planning Board was a request from Empire Dismantlement Corp. at 131 Industrial Drive to rezone from M1-to M-2. A public hearing has been scheduled for Tuesday, Jan. 16, 2007. If granted, the new zoning would permit usage as a contractor’s yard that the Corp. contends is needed for storage of equipment and materials.
   Site plan approval for expansion of Town Hall Terrace senior apartments geared toward independent living for handicapped elderly people was approved subject to certain conditions. The four-unit and two-unit buildings, all one-story, will have light standards on the streets with lights over the garage and at the entries. Engineering is suggesting a 20 ft. utility corridor and a turn-around at the second end. A stockade fence is recommended to keep out the noise from the water park at Fantasy Island. Landscaping will follow town code.
   The Town Board agreed, subject to approval of the Town Attorney, to abandon First Ave. east of Sixth St. with one half going to each adjoining neighbor. The two pieces will be joined to adjacent lots and the Town will keep 40 feet from the easterly right of way of Sixth St. for future needs.
   The following budget amendments were approved: $35,581 for the Highway Department’s wood chipper and another $16,565 for a Bobcat/snowblower; $8,132 to replace the main mail server; $27,358 for Recreation to cover fencing at Kaegebein tennis courts and a new sidewalk at the Golden Age Center; $13,868 in General for employee sick/vacation buybacks; $4,678 in Water for employee sick/vacation buybacks; $13,797 in General for health insurance bonuses; $7,069 in Highway for employee health insurance bonuses; $4,713 in Sewer for employee health insurance bonuses; and $2,045 for a clerk records grant.
   In other business, the Board:
• Appointed Robert Zacher to a two-year term on the Electrical Examining Board.
• Renewed a five-year lease for 3,200 ft. of office space at 1856 Whitehaven Road with a monthly rent of $2000 to house town police and sheriffs offices.
• Authorized the supervisor to file a PO-17 to create a position of court clerk, part-time.
• Announced that Councilwoman Mary Cooke will return a health bonus check of $2,612,80 to the town because she believes health insurance benefits offered by employers were never meant to be a source of income.
• Awarded a bid for polymer for removing phosphorus at the Wastewater Treatment Plant to Polydyne Inc. at $1.05 per pound.
• Awarded a bid to clean and regrade part of Woods Creek to Sam Long Landscaping who was low bidder at $15,935.
• Accepted, with regret, the resignation of Diane Blum as account clerk effective Dec. 29.
• Referred to the Planning Board and Town Engineer a request to split property at 2118 East River Road.

Praise Bestowed On Deserving Islanders - December 2006

   Monday, December 18, 2006 . . .Two proclamations presented by the Town Board Monday spread the spirit of the season by honoring two Island women, both of who have distinguished themselves in their areas of expertise and interest.
   Anna Quider, accompanied by her parents, was recognized for her academic excellence in the field of astrophysics as a recipient of a Marshall Scholarship given by the British Parliament in honor of General George C. Marshall. Quider is one of just 43 to receive a 2007 Marshall Scholarship that will allow her to do post-graduate studies in astrophysics at Cambridge University. She is a University of Pittsburgh honors student majoring in physics and astronomy, the history and philosophy of science and religious studies. (Click "Anna Quider" for separate story).
   The Town Board declared Tuesday, December 19 Joanne Carr Day throughout the Island in recognition of her tireless devotion to Grand Island environmental concerns. Carr was a charter member of the Commission on the Conservation of the Environment that was established in April 14, 1974. She retired from the commission on November 6 after 32 and ½ years of dedicated service. (Click "Joanne Carr" for separate story).

Deadline Set For Branch Pick-Up - 2006

   Erie County has set December 31st as the deadline for picking up branches from the October storm. Weather permitting, the Town of Grand Island Highway Department will continue to make special pick-ups until December 31st. After January 1st they will return to the normal branch pick-up process.
   Residents who have branches for pick-up are asked to move them to the roadside as soon as possible. Special pick-ups, including weekends, will be scheduled as needed through the end of the year.

Town Board Gives Green Light To Park Place Patio Homes - December 2006

   Monday, December 4, 2006 . . . Despite a last minute plea from Anthony Scanio of Bonnywoods not to rush to judgment on Park Place Patio Homes, the Town Board, Monday, gave preliminary plat approval for the cluster development of the 66-residential-lot project. Prior to that they asserted with a negative declaration on the SEQR that there was no significant adverse impact from the development.
   Attorney Sean Hopkins, speaking on behalf of the project, refuted comments that Attorney Jennifer Persico, representing neighboring residents, had made at the previous town board meeting. He asserted that there were no impermissible conditions and no significant adverse impacts. And in addressing the wetlands, he said the developer would provide mitigation on site.
   Town Attorney Dan Spitzer agreed with Hopkins and called the project a win-win for the town in that no wetlands would be lost. He asserted that there had been no rush to judgment because the Town Board had been considering this project over the past four years. Councilwoman Mary Cook described the situation as a problem over buffers between two neighborhoods (Harvey Road and Bonnywoods). Each side wanted increased buffers to protect their privacy on their particular side of the development. The project, as approved, would have equal buffers on both sides.
   No one spoke during a public hearing on sewer rents that resulted in the Town Board setting sewer rents in the Consolidated Sanitary Sewer District for 2007 at $4.40 per 1000 gallons of water usage.
   The Board set a public hearing for 8 p.m. December 18 to air a request from Niagara Development Group to rezone 2.06 acres, west of East River and south of Whitehaven, from R-2 to R1-D to allow seven single-family lots. The item will be on the December 11 Planning Board agenda for anyone interested in attending.
   Referred to the Town Board for review was a revision in town code that would add a paragraph D to 24A-9 addressing Exception to Subdivision Regulations. It would clarify exactly what regulations are being exempt. The paragraph would read. “Recreational site fees would be paid. Land for parks and recreation will be required in lieu of payment if the present or future need dictates.”
   The Town Board, based on a recommendation by the Planning Board, approved a negative declaration for a 14-acre subdivision on Fix Road and waived subdivision regulations for James and Elaine Oakley. The town will take $500 in lieu of 10 percent land per subdivided parcel. This does not take into consideration any development plan, nor the ability to build on the subdivided parcel with regard to setbacks from Corps of Engineer or DEC related waterways or wetlands.
   In other business, the board:
• Authorized the supervisor, subject to approval of the town attorney, to sign the plan documents with P&A for establishing a health reimbursement account for all town employees.
• Authorized a sewer rent refund of $2,276.82 to Andrew Szolnoky at 2407 Long Road who has been paying for sewer rents since 1988 without being connected to a sewer system.
• Waived a requirement for a paved turnaround that is to be replaced with a temporary stone turnaround to be constructed in a manner satisfactory to the town engineer and town attorney at Golf Course Villas.
• Approved a special use renewal for the keeping of three agricultural animals by Richard Benz at 828 East River Road.
• Received, with regret, a letter of resignation from Catherine Knight at the Golden Age Center as of December 22 and approved advertising for her replacement.
• Received, with regret, letters of resignation from Joan Bodkin and Ilona Lang, both of whom served on the Architectural Review Board.
• Authorized the supervisor to sign a memorandum of understanding regarding the repayment of overpaid wages for Jim Federspiel.
• Reminded residents that a Pearl Harbor Day ceremony would be held at noon Dec. 7 at the VFW and that a blood drive would be held at the Fire Hall on Dec. 12.

School Bond Details Aired
Vote Is Set For Dec. 12th - December 2006

   Monday, December 4, 2006 . . .Interim School Supt. Larry Zacher gave a detailed power point presentation on the upcoming School Bond vote Monday during the Town Board meeting. He explained that because of available state building aid and new money through EXCEL aid the time is ripe to do some capital projects and needed repairs at no cost to taxpayers. Both, however, are contingent on the results of a district-wide vote that will take place Tuesday, Dec. 12 from 7 a.m.-9 p.m. in the Grand Island High School main foyer.
   He explained that a needs survey, completed in 2005-2006, is the basis for the bond that would fund the renovation project. Getting priority would be roof repairs at the transportation garage and Middle School and masonry work throughout the district.
   The power point broke down what would be covered by the nearly $4 million bond. Common throughout the district would be masonry restoration/pointing, upgraded telephone system that would include caller ID, direct digital controls, upgrading of emergency generators and air conditioning in computer labs.
   Sidway Elementary, estimated to get $423,000, would also receive window sill replacement/sealants, roof exhaust fans/relief fans and replacement of unit vents.
   At Kaegebein, estimated to receive $280,000, there would also be insulated window panels added, gym mechanical ventilation unit replacement and toilet replacements.
   At Huth Road Elementary renovations are estimated at $370,000 and would include site storm/site grading.
   The bulk of the bond money, $2,377,781, is earmarked for the high school/middle school complex and that would include window sills/sealants, swimming pool paint and lighting upgrades and service room upgrades.
   Funds for transportation center, estimated at $526,000, would take care of asphalt paving/parking, roof replacement, immediate door repair and installation of emergency eye wash.
   EXCEL, an acronym for “Expanding our Children’s Education and Learning,” is a one time grant provided by New York State to help fund education projects and is subject to voter approval. Grand Island would receive approximately $320.46 per student through EXCEL.
   Zacher estimated that the renovation project would take about one and one half years to complete and that the roof and masonry work would take priority. He said that State Building Aid could cover as much as 81 percent of the renovations with EXCEL taking care of the rest.
   Prior to Zacher’s presentation, Jim Mulcahy of West River asked why some of these things couldn’t have been covered by the 1990 capital project of $21 million, especially the Middle School leaks and science labs. He also felt many of the items in the renovation project were maintenance issues belonging in an operating budget not a capital budget. And he wondered out loud what expenditures would be over the next five years. Donald Wilkinson agreed with Mulcahy’s comments and asked why these concerns and expenses were not brought to the taxpayer’s attention last May prior to the School Board vote.
   Councilman Gary Roesch and Supervisor Peter McMahon encouraged taxpayers to go and vote on Dec. 12. Peter McKee, a licensed engineer, said that it made sense to vote for the school bond since the work needs to be done and there is money available.

Thompson Leads Bridge Toll Removal Crusade - December 2006

   Monday, December 4, 2006 . . .Rus Thompson announced at Monday’s Town Board meeting that he had garnered 2400 online signatures and 1000 handwritten signatures in favor of eliminating the Grand Island bridge tolls, and that he would take the petitions to Albany.
   The plea to eliminate tolls that discriminate against residents of Grand Island even though they are discounted 66 cents is not a new issue but the timing may be ripe in lieu of the Buffalo tolls being removed recently. Thompson is working with Republican assemblymen and state legislators on the issue and attracted media attention with his website. WBEN Radio and WIVB-TV are among the media outlets that have given him coverage. He plans a peaceful protest along the bridge if no action is taken.
   In a lengthy document he referred to at the Town Board meeting, Thompson said there are other ways the state can generate revenue including taking back I-287 so it could collect the Tappan Zee Bridge toll. He also advised saving money by rolling back the $200 million spent on member items. Information on costs to maintain the tolls were also provided by Thompson.

Town Approves ’07 Budget, Taxes To Go Up - November 2006

   Monday, November 20, 2006 . . . The average Grand Island household tax bill, based on a $100,000 home, will increase by 2.85% in 2007 according to the budget plan adopted Monday by the Town Board. The General Fund has increased by 4.4 % over last year with $1,841,832 to be raised by taxes despite the fact there will be no raises for the Town Board. Total budgeted for General Fund is $5,866,754.
   There is no increase in the Fire Protection District Budget with the tax rate set at $1.292 per thousand. Amount to be raised by taxes is $896,000, total budget is $917,535. Also showing no increase is the Water District Fund with $681,065 to be raised by taxes for a tax rate per thousand (land value only) of $5.782.
   The Highway Fund includes a 2.2 % increase over last year with the tax rate at $2.990 per thousand and the amount raised by taxes set at $1,935,814 (total budgeted $2,385,439).
   The biggest increase is in the sewer fund with $633,260 to be raised by taxes for a 31.6 % increase over last year. The $7.478 tax rate per thousand is on land value only. Total budget is set at $2,888,399.
   A flat rate of $130 per single family dwelling is a 5.7% increase over last year for refuse and garbage collection. Amount to be raised by taxes is $883,350 with a budget total of $907,975.
   The tax rate for the 47 lighting districts varies by district. Total budgeted amount for 2007 is $200,808 with $190,339 to be raised by taxes.
   Also approved was the figure for the Debt Service Fund ($1,202,622). The number for transfers from other funds totaled $1,150,622.
   A public hearing has been set for 8 p.m. Monday, December 4 for anyone wishing to comment on the 2007 sewer rent.

Park Place Patio Homes, Hot Town Board Topic - November 2006

   Monday, November 20, 2006 . . .In the end, no action (neither SEQR nor preliminary plat approval) took place for Park Place Patio Homes Monday, and the proposed subdivision remains on the Town Board agenda until another time. Many Bonnywoods and Harvey Road residents took to the microphone to state their dissatisfaction with the cluster plan as proposed. They want the developer to increase the buffer on both the Bonnywoods and Harvey Road sides to insure their privacy and they also want adjustments made to the entrance.
   George White said he was disappointed in the developer’s unwillingness to negotiate, and that despite many meetings between residents and developer there has been no progress made. Julius Horvath attested to the residents’ good faith in working three years to insure a better Park Place development, but indicated there had been no good faith shown by the developer. Chuck Morell went so far as to say, “fraud was committed here between the developer and realtor,” alluding to the false promise that the land in question was to remain vacant.
   Attorney Jan Persico, representing the neighboring residents, said two drawings showing increased buffers had been submitted to and rejected by the developer. She added that a quick look at the negative declaration for SEQR raises lots of concerns and is insufficient in addressing wetlands, drainage (stormwater discharge) and traffic. Her contention is that the negative declaration should be reclassified a conditional negative declaration which would provide for a 30-day comment period. She further questioned as to where the environmental assessment form was to deal with the conditions. The Town Board agreed to leave the issue on the table until the town’s lawyers and Attorney Persico could meet regarding the negative declaration.
   A public hearing to consider preliminary plat approval for New England Estates resulted in the matter being referred back to the Town Board because the SEQR was not done. Raising questions about the development were John Granelli and Will Tompkins who both had concerns regarding the vast area of wetlands that may be impacted by development of the 60 lots and potential traffic problems at the entrance of the proposed project.
   A second public hearing concerning the installation of “no parking” signs at the north end (turnaround) of Glen Avon brought out several bus drivers who said cars that parked there made it nearly impossible for them to turn their buses around. The Town Board adopted Local Law 10 banning parking at the north end of Glen Avon during the months of November and December. This would keep hunters from parking in that area during hunting season.
   In other business, the board:
• Authorized the supervisor to sign a memorandum of understanding regarding the repayment of overpaid wages by Francis Ziemba.
• Authorized the supervisor to sign an agreement with Administrative Services Inc. for administration of a flex spending plan regarding group insurance for employees.
• Adopted a resolution in support of a $1.5 billion upgrade by NRG Energy Inc. of the CR Huntley power plant located off River Road in Tonawanda that would double generating output from 552 megawatts to 1,010 megawatts by 2012.
• Referred to the town attorney a request from Golf Villas at River Oaks for sewer and water easements.
• Authorized advertising for bids for polymer used in phosphorous removal at the Water Treatment plant.
• Authorized a request for proposals for professional engineering services as regards a Master Plan for Bicentennial Park/Scenic Woods with bids to be open on December 13 at 10 a.m.
• Denied a request from Niagara Development Group to rezone two lots on East River Road from R-2 to R-1E as it would be setting a precedent for spot zoning.
• Referred to the Planning Board and Recreation Advisory Board a request from James and Elaine Oakley to split a lot on Fix Road.
• Received and filed a concept plan for Woods Creek Townhouses at 1993 Grand Island Blvd.
• Referred to the Planning Board, Highway Supt., Town attorney a request for abandonment of a paper street (First Ave. east of Sixth St. between 2307 and 2287 Sixth St.)
• Referred to the Traffic Safety Advisory Board a petition requesting stop sign and reduction in speed limit for Majestic Woods.

Public Hearing On 2007 Preliminary Budget - November 2006

   Monday, November 6, 2006 . . .The Town Board heard from two individuals questioning the 2007 Preliminary Budget at a public hearing Monday evening. George White of Harvey Road questioned the proposed 30% increase in the sewer rate while Doug Learman, department head of the Grand Island Code Enforcement department spoke in opposition of the budget due to lack of funds to adequately staff his department. Mr. Learman noted that the town is being negatively affected with poor ratings from insurance companies and non-compliance with fire and safety inspections that date back to standards set in 1984. A second public hearing is scheduled for November 20, 2006 on the 2007 budget.
   The board approved the motion to authorize the Supervisor to submit a contract with the Erie County Community Development Block Grant for a new 15-passenger van for the Golden Age Center and a project to install a sidewalk on the south side of Love Road between the South State Parkway and East Park Road.
In other business, the board:
  • Authorized the renewal of the Co-Op Resolution with the City of Niagara Falls to purchase chemicals for water and wastewater departments.
  • Approved the request from Recreation Director Linda Tufillaro to hire two part-time recreation attendants for the winter programs: 2006-2007.
  • Authorized the renewal of a special use permit to Michael and Judith Schneider of Harvey Road for the keeping of 3 agricultural animals on 6.02 acres.
  • Authorized the renewal of a special use permit to Thomas Thompson of Long Road for the keeping of up to 2 equine animals on 3 acres.
  • Received with regret the resignation of Joanne Carr from the Commission for the Conservation of the Environment after 35 years of service.

    Hoyt Secures $2.7 Million For Grand Island Transportation Improvements - 2006

       Assemblymember Sam Hoyt (D-Buffalo, Grand Island) announced today $2.7 Million dollars in state aid for important Grand Island transportation projects.
       Hoyt said, “I am pleased to be able to provide these funds to facilitate a significant traffic upgrade which will greatly enhance residents’ and visitors’ quality of life.”
       The funds will be utilized to upgrade the intersection at Staley and Grand Island Boulevard to address a significant traffic impediment at one of the Island’s primary intersections. This upgrade will create right and left turning lanes to address significant traffic backup at rush hour, and also other times and was identified as a priority by Town Supervisor Peter McMahon. Additionally, funds will go towards creating a bike path and sidewalks along Grand Island Boulevard.
       Supervisor McMahon commented, “When this project is completed, we will have improved traffic flow at the worst intersection on Grand Island. In addition, we will have made a portion of Grand Island Blvd. safer for the Island’s bicyclists and pedestrians.”
       Hoyt continued, “Grand Island Boulevard is one of the Island’s primary thoroughfares, and the creation of sidewalks and bike paths will greatly enhance this roadway and contribute to the welfare of the businesses that line it, as well as providing a safe and convenient way for bicyclists and pedestrians to traverse the Island.”

    Town Approves Hiring Of Part-Time Police Officers - October 2006

       Monday, October 16, 2006 . . .The Town Board, Monday, approved the hiring of six part-time police officers for the town. They are Michael Cali Jr., Tim Franz, Jordan Graber, James Hatch, Robert Rine and Daniel Walczak. Supervisor Peter McMahon will submit the PO17s to the county to expedite the hiring.
       A public hearing, at which no one spoke, was held on possible Community Development Block Grant projects. Grant requests will be submitted for a new bus for the Golden Age Center and a sidewalk on the south side of Love Road to service Kaegebein School.
       The following individuals were appointed to the Planning Board: Sarah Cashimere for a term expiring Dec. 31, 2008 and Audrey Czesak for a term expiring Dec. 31, 2012. Announced was the hiring of Robert Fraser as a part-time seasonal employee and David Stamler as a seasonal employee in the Highway Department to supplement the winter work force.
       Approved as requested was the hiring of recreation attendants for the Winter Recreation program all at $7 per hour as follows: two returning lifeguards James Sica and Catie Remmes, new lifeguards Joshua Kaplan and Kristin Millar, returning attendants Cortney Bota, Colleen George, Tim Boorady, Amy Stewart and Ben Kozar, and new attendants Deborah Brennan, Michael Steckelberg and Michael Gallagher.
       It was announced that the Town Clerk’s office will now be able to take photographs for passports. Passport applications are accepted during regular business hours and by appointment anytime. The same applies to the taking of passport photos.
       Approved, subject to a deed restriction requiring a sidewalk at some time in the future when the town deems appropriate, was an exception to the sidewalk requirement for David Homes at 7 Windham Lane. Also approved was a site plan and grading permit for Thomas Snyder at 2671 Bedell Road to fill in a previously excavated area.
       An exception to subdivision regulations was approved for Lynette Ovitt of 2515 Stony Point Road who plans to separate a back lot from a front lot and join it to adjacent back lot.
       Though New England Estates request for preliminary plat approval remains tabled due to pending comments from the Parks & Recreation Advisory Board and Conservation Board, Will Tompkins of Bishops Gate aired his concerns regarding traffic, wetlands, the National Fuel line and other environmental impacts related to this subdivision.
       A request from residents in Majestic Woods to apply for a grant to help with the installation of flowering pear trees was referred to the grant consultant and the town attorney who will research the establishment of a special tree district. Already referred to the Traffic Safety Advisory Board was a request for a stop sign to be installed at the T intersection in Majestic Woods and for a reduction in the speed limit to 25 mph. Majestic Wood residents are also requesting permission from the town to maintain the rip rap stone that has been placed on the slope to the pond on the properties. Residents claim the stone beautifies, is easy to maintain and prevents additional erosion. This request has been referred to the Conservation Board.
       Supervisor Peter McMahon, at the close of the meeting, thanked all town departments for the part they played in mitigating the October Surprise storm and stated that Grand Island faired well overall. He praised Deputy Supervisor Dick Crawford for acting on his behalf and said that Crawford did everything he would have done during the emergency. He reiterated that Grand Island water throughout the storm was always safe to drink because of its own water treatment plant.
       In other business, the board:
    • Authorized the supervisor to sign the professional services agreement with Stearns & Wheler, LLC for the overflow retention facility (ORF) spray wash system and liner replacement design and construction services.
    • Accepted with regret the resignation of James Mysliewiec from the Traffic Safety Advisory Board.
    • Open period set for agricultural district inclusion
       The Erie County Legislature has designed November 1-30 as the annual 30-day period within which a land owner may request predominantly viable agricultural land for inclusion to a certified agricultural district in accordance to Section 303-b of the NYS Agricultural and Markets Law.
       Land owners may obtain a copy of a form to be filled out accordingly at their Town Clerk’s office or through Planner John S. Opalka, Erie County Dept. of Environment and Planning, 95 Franklin St., Buffalo, NY 14202, or by calling 858-6229.

       Shown is the result of three "chipping" crews working dawn to dusk around Grand Island since Saturday morning, October 14, 2006. According to Town Supervisor Peter McMahon, there were 50 truck loads of mulch dumped over the weekend and many more since. The pile in Beaver Island State Park (above) is estimated to be 200' long, 20' wide and up to 14' high.
       With the cancellation of the Fire Prevention events schedule for Friday, October 13 when preparations had been made to make hot dogs available, the Fire Company provided lunch on Wednesday for the town highway crews clearing the fallen branches.

       Grand Island Town Supervisor Peter McMahon, along with the Town Board, heads of the Highway and Engineering departments, and Fire Chief Greg Butcher gave an update Monday, October 16, 2006 on the status of the town in the wake of what has been dubbed the ‘October Surprise Storm.’ According to the town officials on hand, Grand Island is up and running, but clean-up will likely take many months.
       “We’ve faired better than most,” Supervisor McMahon began. "As of Monday, 99 % of the power is back on in the town, the major exceptions being two town blocks. Specifically, the north side of Love Road between Stony Point and East Park, the south side of Hennepin, and Beaver Lane are still dark but “[these] should be restored today,” The Supervisor explained. Some individual households make up the rest of the one percent still without power. McMahon congratulated Deputy Supervisor Richard Crawford Jr., who ran operations the first 24 hours in the supervisor's absence. “I’d be remiss if I didn’t give credit to him,” he said.
       The supervisor also explained that with 70% of the Island without power, the Town's waste water system was heavily taxed. One of the town's lift stations flooded and was being assessed the damages, which might be considerable. Regarding the Stafford Act Declaration, Supervisor McMahon added the public should be aware of individuals posing as FEMA officals. "FEMA does not go door to door to solicit information or contracts," he said. "If some individuals should approach homeowners implying they are from FEMA, the homeowner should call the police and report the incident."
       Councilman Gary Roesch hailed the collective efforts of the town: “We were put to the test and we faired really, really well.” At the peak of the storm, 70 percent of the Island’s power was out. The most damage was incurred by the Island’s Grandyle Village and sections east of the South Parkway and south of the South Grand Island Bridge, due to the course of the lake effect band.
       Highway Superintendent Ray Dlugokinski reported his department’s biggest challenge: “debris pick up.” Unable to give a definite time frame within which this challenge could be met, he offered a guess of two months for completing one Island-wide pick-up. The department will make two pick-ups total. Dlugokinski listed the pick-up areas in order of priority: First, the areas children use walking to school; second, more densely populated areas such as subdivisions; and third, outlying roads. Asking for residents’ patience, he said, “Bear with us. We will get to [you].”
       The Supervisor has been participating in the twice-daily conference calls with the Erie County Emergency Operating Center, and has made requests for pumps, generators, and especially chipping crews. Specifically, four chipping crews have been requested through November 1. Even with Highway Department crews working dawn to dusk, the town owns only three chippers: simply not enough for the task at hand.
       Fire Chief Greg Butcher reported two dispatchers were on duty around the clock from Thursday through Monday morning. The dispatcher answered more than 1,000 phone calls, with GIFC responding to approximately 175 incidents, mostly electrical hazard in nature. Chief Butcher could not stress enough the precautions people should take when using the generators and portable pumps. The Fire Chief also reported that calls to the Fire Company dispatch office have now evened out, and the fire company is currently organizing its resources. He offered the following warning to all communities affected, “Be very cautious on the use of generators.”
       Regarding aid from FEMA, McMahon confirmed, “We’ve incurred expenses and we’ll apply for aid.” A Stafford Act Declaration has made $5 million available to affected municipalities. He added that the next step will be for FEMA to determine if they will release more aid to businesses and/or individuals. At this point, there is no guarantee of reimbursements to individuals or businesses, but McMahon advised keeping track of storm-related purchases.
       The town is continuing to respond to individual requests for assistance whenever it is required. If the town itself cannot provide the help sought, a referral will be made. Normal Friday garbage collection in the town was cancelled last week. Residents affected are asked to hold their garbage, preferably in a secure location away from weather and animals, until pick-up this Friday.
       Remaining power outages should be reported to 1-800-Niagara. Other non-emergency issues may be called in to the Fire Company dispatcher at 773-4334.





    Supervisor McMahon - No Need To Boil Water - 2006

       Tuesday, October 17, 2006 . . .Supervisor Peter A. McMahon has made the following announcement:
       Information is being given out by several sources that residents of all Erie County municipalities except the City of Buffalo, must boil water before drinking or cooking. This information applies to Erie County Water Authority customers only. The Town of Grand Island has its own independent water system. The system has maintained its integrity throughout the storm. Boiling water is not necessary for residents of the Town of Grand Island.





    Period Extended for Erie Co. Residents to Pay School Tax - 2006

       Monday, October 16, 2006 . . .Due to the Columbus Day 2006 storm repercussions, Governor George E. Pataki today announced that he would sign an Executive Order to extend the period for Erie County residents to pay their school tax bills. School tax bills are due in Erie County on Monday, October 16. Without the Governor's action residents of Erie County who had not paid their taxes by that deadline would have been subject to interest. The Governor will formally sign the Executive Order n Monday October 16, 2006.
       The Town Clerk's office will be open regular business hours, 8:30 a.m. to 5 p.m., Tuesday, October 17 through Monday, October 23.

        The Grand Island Town Board and the Grand Island Traffic Safety Board wishes to announce that a full signal has gone into operation at the Staley/Baseline intersection as of Wednesday, October 4th at 10:00 a.m. The traffic board completed a traffic study at the intersection and presented the findings to the county. This information resulted in the approval of a full signal.        A Public Hearing will be held on Monday, October 16, 2006 at 8:00 P.M. at the Grand Island Town Hall, 2255 Baseline Road, regarding the use of Federal Community Development funds in the Town of Grand Island.
       The Town of Grand Island is eligible for a Federal Community Development grant under Title I of the Housing and Community Development Act of 1974, as amended.

    2006/2007 School Tax Bills Have Been Mailed - Sept. 2006

       Town Clerk Patricia A. Frentzel announced that the 2006/2007 School Tax Bills have been mailed. If you have changed banks, have paid off your mortgage or do not have an escrow account and did not receive a tax bill, please contact the Town Clerk’s office at 773-9600 ext. 620. The office will be open Saturday, October 14, 9:00 AM - 1:00 PM. Checks should be made payable to Town Clerk. The last day to pay without penalty is October 16. Envelopes must show a legible postmark of October 16 to be accepted on time. Taxpayers should call the office for correct amounts for payments made October 17 and later. Personal checks are not accepted after November 15 and payments can be made until November 30, 2006. After this date, payments must be sent to the County.

    Phase I of Woods Creek Subdivision Up For Discussion - September 2006

       Tuesday, September 5, 2006 . . .Several people spoke during a public hearing regarding the preliminary plat approval of Woods Creek Subdivision Phase I. Attorney for Parkland Development Marla Brown described the project as 24 single-family lots in R1-D zoning. A drawing was submitted by Civil Engineer Peter Johnson who added that the five acres of the 17 acres involved would be conserved and dedicated to the town. Two other acres are wetlands.
       But concerned Island environmentalists don’t like the way the development is unfolding. Dorothy Westhafer says the development plan as a whole is unresolved with Phase I originally described as Phase 4. Her concerns centered around the juxtaposition to Majestic Woods and whether there is a need for another detention pond. Her priority is to protect Woods Creek and asserted that buffer maintenance is significant.
       Frank Burkhart also objected to the piecemeal development of the project and called for a whole project plan, complete with overall wetlands control. He feels there are significant changes since the last SEQR, wonders about the curb cut onto Stony Point from the store site, and suggested the need for more traffic studies.
       Greg Chamberlain added his concerns primarily how the project would affect his property since he already gets significant water run off on his driveway.
       The Town Board, considering the comments, tabled the issue until there was further review.
       A 4-1 approval to amend the zoning map from M-1 to M-2 for a contractor’s yard at 2569 Whitehaven Road for Jerod and Jim Battaglia was granted. Residents who had vigorously spoken against the rezoning previously, were silent after the action. Supervisor Peter McMahon advised those concerned about the project to attend the Planning Board meeting at which specifics of the site plan would be discussed.

    Isle Police To Serve Eviction Notices - September 2006

       Tuesday, September 5, 2006 . . .The Town Board, Tuesday, adopted a resolution empowering Grand Island police officers who are trained and experienced in serving eviction notices to do so in order to help the Erie County Sheriff’s Department which is suffering from a backlog of notices. Board members felt the action would better serve Grand Island property owners. Each eviction notice will be delivered by two police officers for safety reasons. In addition, the board approved amending the fee schedule to include service of eviction notices at a cost of $119 per person served.
       A grant application for funds needed to restore the Dunlop Building may be available through a state grant. If awarded the grant would fund asbestos abatement, building-related rehabilitation, and infrastructure improvements including sewer. Costs for the work would be shared by the property owner and the state grant. Comments on the grant will be aired at a public hearing September 18 at 8 p.m. Also aired will be a special use application from Niagara Falls KOA for the construction of a caretaker’s residence on the property. Yet another public hearing will consider preliminary plat approval for Buckhorn Estates (formerly Buckhorn Park/Long Road Subivision a.k.a. Lang Farm).
       The Town Board referred a letter from the Commission for the Conservation of the Environment on environmental concerns regarding Phase II of Meyer-Sheenwater Estates located on the north side of Love Road back to the town board for further review. The letter pointed out that plans for development would impact pristine wooded areas that contain northern hardwoods and vernal pools. Several recommendations to protect the forested area were outlined for the board’s consideration.
       A site plan for a 53-space parking lot with drainage was approved for Country Glenn Apartments at 2225 Bedell Road as was a parking lot for Harbor Lights Fellowship Church at 1821 Grand Island Blvd.
       In other business, the board:

    • Rejected all bids for a medium duty pump truck for the water department as they all came in over the budgeted amount.
    • Authorized the supervisor to sign a consent form allowing the GI Snowmobile Club to use Niagara Mohawk Power land for the purpose of a snowmobile trail.
       Residents were reminded that the Antique Boat Show would take place at the Buffalo Launch Club this weekend and that the inaugural concert of the Grand Island Community Chorus would be held at Historic Trinity Church at 7 p.m. Sunday, Sept. 9.
       Residents were also reminded of the 21st Annual Beach Sweep set for September 16. All residents interested in helping should meet at the Environmental Chapel, 3449 West River Road at 9:30 a.m.




    Residents May Drop Off Hazardous Waste Saturday - September 2006

       Tuesday, September 5, 2006 . . .Erie County has scheduled a household hazardous waste drop off day from 9 a.m. to 2 p.m. Saturday, September 9 at Honeywell Specialty Materials, 20 Peabody Street, Buffalo.
       Acceptable items include lawn, garden and pool chemicals; household chemicals and cleaners; aerosol cans; oil based paint; paint thinner; stripper and solvents; batteries (lead acid and rechargeables); automotive fluids; mercury; propane and marine flares. Some quantity limits may apply.
       Items not allowed are alkaline batteries, asbestos, compressed gas cylinders, cooking/frying oils, fire extinguishers, fluorescent bulbs, Freon, latex paint, medicines, smoke detectors, syringes and tires. No commercial wastes or computers, electronics and appliances will be accepted.

    Local Laws Adopted On Street Closures & Stop Signs - August 2006

       Monday, August 21, 2006 . . .No one spoke during six public hearings, Monday, which allowed the Town Board to dispatch agenda items with expediency.
       Two local laws were adopted changing the way the town deals with street closure requests and stop signs. Local Law #7 puts a formal process in place for the closing of streets for block parties or other neighborhood events. An application for a permit to close the street should be made at least 20 days before and no more than one year before the date. After application is made, the town clerk will announce a public hearing to be published in the official town newspaper. Upon approval by the town board following the hearing, a permit will be issued. Applicants for street closures are responsible for removal of litter and debris, for notifying all abutting residents within 10 days of the party and for allowing emergency vehicles on the road if needed. A subsequent public hearing on t\he closing of Settlers Row between #50 and #64 for a block party September 9 from 2-7 p.m. was held and the street closing was approved.
       Local Law #8 calls for a public hearing on the installation of all stop signs and adoption on the placement of each stop sign by the Town Board. Monday a public hearing was held on placing a stop sign at the west end of Luther Lane at Pin Oak Circle and at the southeast corner of Countryside at Oakridge. Both were approved as Local Law #8.
       As the result of another public hearing, final plat approval was granted for Golf Villas at River Oaks Phase IA and for re-affirming approval of Golf Villas Phase I at Whitehaven Road.
       Following two public hearings on the establishment of lighting districts in Hidden Oaks Subdivision – Phase 3, the board approved the creation of Lighting Districts No. 48 and 49.
       The Town Board tabled ruling on a petition by Jerod and Jim Battaglia to rezone 2569 Whitehaven Road from M-1 to M-2 because SEQR had not been done. Furthermore, it was determined due to the number of names on a petition against the rezoning, a super majority of the Town Board would be needed for any ruling. Fran and Claudia Preve distributed a letter to members of the press indicating that the lot in question is not adjacent to M-2 zoning and asserted that if storage yards already existed in M-1 they are doing so illegally.
       Subdivision regulations were waived for Fuccillo Automotive Group which would combine 12 existing lots and re-divide them into five parcels. During the workshop, the board also agreed to waive a 30-day written notice for a conservation easement on the Toyota site.
       A public hearing has been set for 8 p.m. Tuesday, September 5 on revised preliminary plat approval for Woods Creek Subdivision – Phase I. The revised plan does not require any variances and wetlands impacted are considered low grade.
       In other business, the board:
    • Appointed David Castiglia of Harvey Road as Dog Control Officer Part-time, Grade 4, Step A effective August 22.
    • Accepted with regret the resignations of Diana Schwartz from the Library Board of Trustees after 20 years of service, Joe Ippolito from the Economic Development Advisory Board and Nolan Bruce Allen from the Planning Board.
    • Referred to the Town Board a letter from Anthony and Ann Scanio opposing the proposed Park Place Patio Home project.
    • Referred to the Town Attorney a letter from Michael Metzger, P.E. advising a broader interpretation of R-2 zoning that would allow for a residential mix in River Oaks.
    • Referred to the Town Board a letter of apology from Fran Preve regarding comments made about Councilman Roesch’s presence at a Planning Board meeting.
    • Awarded a two-year traffic signal inspection and emergency service contract to J.J. Emergency Electric in the amount of $750 for the first year and $800 for the second year.
    • Renewed the HVAC Preventive Maintenance Contract with M.J. Mechanical Services Inc. for Grand Island Town Hall at a rate of $3,869.
    • Authorized the supervisor to extend the funding agreement with the State through March 2007 for the Scenic Woods/Bicentennial Park Master Plan.
    • Authorized the supervisor to sign a contract with Ecology & Environment of Lancaster for professional services in conjunction with the New York Power Authority re-licensing at a cost equal to time and materials not to exceed $13,500.
    • Approved a new hire ($7.50 per hour) for the Parks & Rec. Dept. to replace workers who had to leave for college early.
    • Reminded the public that the next Town Board meeting would be held Tuesday, Sept. 5 following the Labor Day holiday on September 4.

    Residents Can Use Credit Cards To Pay School Taxes - August 2006

       Monday, August 21, 2006 . . .Supervisor Peter McMahon was authorized to sign an agreement with PFOIL that would allow Islanders to make a tax payment for school and town/county on-line with a credit card or electronically with a check.
       This service will allow real estate and appraisal companies to directly access information regarding assessments and tax payments on-line 24 hours a day. Though there is no cost to the town, residents will be advised prior to payment processing that a convenience fee will be charged to them and be paid directly to the vendor.
       The new payment method should be in effect for the school taxes in September.

       Town Clerk Patty Frentzel began issuing hunting and fishing licenses on Monday, August 14, 2006 including Bryan Deuble's first license. Licenses are valid from October 1, 2006 - September 30, 2007 and became available for purchasing on Monday, August 14th, 2006.     Passport Applications Accepted At Town Hall - 2006

       The Town Clerk's office accepts passport applications, a service that is only available in two places on Grand Island. Town Clerk Pattie Frentzel's office is open from 8:30 a.m. to 5 p.m. Appointments for acceptance of applications may be made with the town clerk or with Deputy Clerk Karen Cooney anytime. However, photos must be supplied.
       According to Mrs. Frentzel, as of January 2007 all air and sea travel will require a passport to Canada, Mexico, the Caribbean, Bermuda, and parts of Central and South America. As of January 2008 all land crossings to Mexico and Canada will require a passport.

    Coppola Allocates $5000 To Town of Grand Island
    Funding to be Used For Seating at Veterans Park - 2006

       GRAND ISLAND, N.Y.—Today, New York State Senator Marc. A Coppola (D-60th district) presented Grand Island Town Supervisor Peter McMahon and Recreation Director Linda Tufillaro with a check for $5,000 to be used for Veterans Park. The money allotted comes from the Senator’s member item funding through the State Budget and will be used for park amenities including, picnic tables, benches and umbrellas. The presentation took place at Veterans Park, Grand Island.
       “Veterans Park is a wonderful recreational facility on Grand Island,” said Senator Marc Coppola. “With all of the recreational sports that take place here, there is a demand for more seating. I am happy to have been able to meet the Town of Grand Island’s request and help provide much needed seating that will make the park more enjoyable for everyone.”
       Supervisor McMahon said, “We are very pleased to have the Senator provide funding to purchase these items for Veterans Park. This park is a wonderful asset for the Town of Grand Island, but unfortunately two things it lacks most are seating and shade. This furniture will benefit park users and spectators.”
       Recreation Director Linda Tufillaro said, “We have worked very hard to make Veterans Park a place where residents of all ages can go and enjoy the outdoors. This allocation from Senator Coppola will put the final pieces of the puzzle in place, allowing us to create a gathering place near the concessions where people can sit down in the shade, have something to eat and still be able to view all of the recreational fields.”
       Marc Coppola represents the 60th Senate District, which is comprised of a large portion of the Cities of Buffalo and Tonawanda, Grand Island and the City of Niagara Falls.

    Public Hearings Take Up Lion’s Share of Town Board Meeting - August 2006

       Monday, August 7, 2006 . . .Three of the four public hearings, Monday, brought lots of residents to town hall to comment on several development plans. No one spoke however during a fourth hearing on Abraxis Pharmaceutical Products’ site plan for a 976 sq. ft. cooler facility and a 960 sq. ft. alcohol storage building. Thus, the town board approved the site plan expansion for the Staley Road company.
       Fuccillo’s Automotive Group’s site plan approval for a Hyundai dealership on 11.77 acres on Alvin Road and subsequent hearing on a conservation easement evoked response from several citizens who feel that Fuccillo’s huge business is taking a toll on the Island aesthetically and otherwise. Ed Dylag of Staley Road opposed the new dealership saying it impacted low density residences and that a build out of the five dealerships that are planned would encroach on nearby neighborhoods. He cited problems with illumination, noise and car and truck traffic and mentioned the 80 acres of woodland that are being destroyed. Other comments asserted that the blow up characters were a blemish and that a foul smell emanated from the car wash systems. There was a request for submission of a lighting plan that would eliminate lights at night. Those opposed said Grand Island was not huge it was grand and they wanted their Island back.
       Dorothy Westhafer and Jim Tomkins asked that the Western New York Land Conservancy be a third partner in the conservation easement. Its expertise would be valuable in overseeing and maintaining the wetlands that Fuccillo was enhancing in the rear of the property as part of its mitigation project. Fuccillo’s responsibility for the wetlands and the Army Corps of Engineer’s inspections end after five years whereas the Land Conservancy would monitor it on a consistent basis. However, despite their comments, the Town approved the conservation easement as written without mention of the Land Conservancy’s involvement.
       Bringing the most voices of concern and opposition was the request by Jerod and Jim Battaglia to rezone 2569 Whitehaven Road from M-1 to M-2 to construct a contractor’s yard. Leading the citizens group objecting to the rezoning was Daniel Sheff who presented a petition with 49 names, gave a lengthy argument and called on several other speakers who added their concerns. Foremost, the residents felt it was contrary to the Comprehensive Plan, would destroy the character of the neighborhood, and have negative impacts on Whitehaven Road traffic.
       Nicole Gerber asked the Town Board to look at the historical uses of M zoning and showed a map that contained 18 empty business sites on Grand Island Blvd. that would be better suited for the contractor’s yard. Richard Meyers provided traffic reports that showed there had been 145 accidents on Whitehaven Road in recent years and cited the Thruway egress and exit on Whitehaven as particularly dangerous. Ken Johnson emphasized that though there was M-1 and M-2 zoning in the area, the neighborhood was primarily residential and the contractor’s yard would negatively impact home values.
       In light of the information presented, the Town Board referred the rezoning request back to the Town Board for further review.
       Four public hearings have been set for 8 p.m. August 21. One is a request to close Settlers Row from #50 to #64 except for emergency vehicles for a block party September 9 from 2-7 p.m. with a rain date of Sept. 10. A related public hearing will address amending a local law that would allow the Highway Superintendent to issue a permit for temporary closing of a street.
       Requests for stop signs at the southeast corner of Countryside and the west end of Luther Lane at Pin Oak Circle were referred to the Town Attorney who will amend a local law that will be aired August 21 at 8 p.m.
       A public hearing to consider final plat approval of Golf Villas at River Oaks – Phase IA and to reaffirm approval of Phase I will be held August 21 at 8 p.m. The final public hearing for August 21 will address the creation of Hidden Oaks Subdivision – Phase 2 Lighting District No. 48.

    Cluster Concept For Park Place Patio Homes Gets Preliminary Nod - August 2006

       Monday, August 7, 2006 . . .The Town Board, Monday, granted cluster concept approval for the Park Place Patio Home development. It is just a first step in the process that still requires Planning Board review and recommendation and public hearings. The project is proposed on 29 acres at Whitehaven Road, east of Harvey Road.
       Currently the land is zoned R-1B for single family homes and was previously zoned M-1 for manufacturing. Smith Ventures is seeking an R-2 rezoning to accommodate patio homes which allows for 40% green space (15% more than required) located around the perimeter. This would give neighbors backing up to the project more privacy according to developers.
       Russell Certo was given a waiver for site plan review of his apartment building at 1282 Stony Point Road based on the fact there would be no changes to the outside of the building.
       Resolutions accepting the sanitary sewer and public drainage easements for Hidden Oaks Subdivision Phase Three were approved. Also accepted was the annexed Deed of Dedication of the town highway to be known as Oakridge Road in Hidden Oaks.
       Special use renewals were approved for Sandy Beach Yacht Club’s parking lot at 1851 Winter Road and for the operating of a natural gas regulator/metering station by National Fuel at 1589 Stony Point Road. A special use permit was granted to Cyrus Ardalan of East River Road for the keeping of 10 equine animals on 50 acres of land. Site plan approval was given for excavation and grading activities to extend existing piping at an existing ditch on the property of Charles Galante of 3387 Staley Road.
       The Town Board authorized improvement projects to an area north of the football field in Veterans Park the Grand Island Jr. Viking Association subject to the approval of the town attorney. The Jr. Vikings will clear the land of weeds so they can use it for football practice.
       Referred to the Special Districts Committee for review and recommendation is a letter from Andrew Szolnoky Jr. of Long Road who is claiming a refund of sewer charges dating back to 1987 since his property is not hooked up to the sewer system.
       In other business, the board:
    • Authorized the town engineer to issue a Public Improvement Permit for River Meadows Section V.
    • Appointed Carol Harvey of Baseline Road to the Board of Assessment Review for a five year term expiring Sept. 30.
    • Authorized the supervisor to sign a federal aid agreement with the State DOT for participation in the administration and funding of the Grand Island Bike Trail Connection Project (a multi-use trail with connections to and within Buckhorn Island State Park).
    • Accepted with regret the resignation of Sal Gullo from the Economic Development Advisory Board.
    • Adopted the Grand Island Safety and Health Program manual subject to the approval of the town attorney.
    • Authorized the Highway Dept. to reject current bids and re-advertise for bids on a four-wheel drive loader.
    • Authorized the supervisor to sign one-year HVAC Maintenance Service Agreements for the Nike Base and the Library and Parks Building with M.J. Mechanical (Nike Base fees are $1,980 and Library & Parks Building, $2000).
    • Authorized Peter Sukmanowski of Colonial Drive West and Thomas C. Dewey II of Whitehaven Road to attend the 108th Basic Course for Police Officers at the Erie County Dept. of Central Police Services Law Enforcement Training Academy.
    • Reminded the public that the Mobile Auto Bureau is on Grand Island Wednesdays from 10 a.m.-3 p.m. for the convenience of residents.

       Monday, August 7, 2006 . . .Rotary exchange student from Thailand, Phichai ‘Max’ Opaskiatikul, who spent a year studying at Grand Island High School as a student ambassador, was recognized twice Monday night with proclamations from the Town of Grand Island and the Erie County Legislature. Cited were his efforts as a volunteer assisting the Rotary Club of Grand Island with its hot dog sale and lobsterfest, the building of a wheelchair access ramp for a cancer patient and assisting in the packing of food for Hurricane Katrina victims.
       In addition, Max completed a 53-hour volunteer internship with the Erie County Sheriff’s Law Enforcement Explorers, participating in their Gun and Safety Program and qualifying in rifle/pistol shooting. He attended police training courses earning a certificate of course completion and honorary captain’s bars.
       The Town Board bestowed upon Max the title of honorary citizen of Grand Island and the Erie County Legislature declared August 7th “Max Day” in his honor.
       Joseph Synakowski and Joseph Stefaniak, representing the 82nd Airborne Division Association, were on hand to receive a proclamation declaring August 16 National Airborne Day in the Town. They presented Supervisor Peter McMahon the Airborne flag to fly on that date commemorating those Airborne Division troopers who fought and died for our nation, notably two who are from Grand Island.
       The Island is the birthplace and final resting place of Pfc. Charles N. DeGlopper who was posthumously awarded the Congressional Medal of Honor for his heroic actions while serving as a member of Company “C” Battalion, 325th Glider Infantry Regiment at LaFiere, France on June 9, 1944. The Island is also the birthplace and final resting place of Lt. Col. Terrance K. Crowe, trained Airborne trooper serving with the 98th division, who was killed by hostile fire while part of offensive operations in Tal Afar, Iraq on June 7, 2005.

    Park Place Patio Home Plan Prompts Much Discussion

       Monday, July 17, 2006 . . .Residents nearby the proposed development of Park Place located at Whitehaven Road, east of Harvey Road, came en masse Monday to voice concerns about the project. Before they spoke, however, Sean Hopkins of Smith Ventures explained that the land in question would be developed as cluster homes (patio) or single family homes.
       Currently the 29 acres of land is zoned R-1B for single family homes and was previously zoned M-1 for manufacturing. Smith Ventures is seeking an R-2 rezoning to accommodate patio homes and Hopkins suggested this was the better plan because it allows for 40% green space (15% more than required) located around the perimeter and giving neighbors backing up to the project more privacy.
       James Dinsmore said that Smith Ventures had proven itself with other developments and testified to the environmentally sound elements and good intentions presented in the cluster plan. David Wilson and Richard Anderson also said the cluster plan was the best one for that particular parcel.
       A letter from Chris and Kyle Aronica in favor of the developer’s request for patio homes pointed out the advantages of the extra green space and indicated patio homes would have less of an impact to Spicer Creek than single family homes.
       Jennifer C. Persico Esq., a lawyer representing Bonnywoods residents, spoke in opposition to the development, and although she said patio homes were preferred over single family homes by the residents, the project raised lots of issues especially concerns over the lack of an adequate buffer on both ends of the development.
       Neighbors like George White pointed out that for those on the pipeline side of the property, the green space wouldn’t provide any privacy because nothing is allowed to be planted within 10 ft. of the pipeline. He suggested the developer and the residents work together to create a better plan. Sharon Federico said she would have no buffer except for the pipeline and prefers the single family home plan. Theresa Eberhard says she equates green space with trees and the buffer on the pipeline side wouldn’t have any trees.
       Like Smith, Julius Horvath favored the cluster development but in a modified plan that would increase the buffer and suggested the developer reduce the number of units.
       As a result of the comments, the Town Board decided to table the item and took no action to approve the cluster development.
       There was no comment during two other public hearings to close roads for block parties and both road closings were approved. Wallace Drive between Huth and South Park will be closed to traffic from 2-4 p.m. Saturday, July 22 except for emergency vehicles. Park Place be closed between homes 106 and 132 from 1:30-8 p.m. on Sunday, August 20.
       The Town Board adopted a resolution calling for the repeal of Real Property Law 339-y that allows for lesser tax assessments on condominium properties. This creates unfair and unequal assessment practices and burdens property owners who are not condominium dwellers.
       In other business, the Town Board:
    • Appointed Robert Figliola of Settlers Row as an outside independent legal counsel for certain legal services in the town court at a per diem rate of $200 with a maximum of five days a year, subject to the approval of the Erie County District Attorney.
    • Appointed Norman Machelor of West River to the Planning Board to fill the balance of a vacated term ending December 31, 2011.
    • Approved a change order in the amount of $553.96 for additional work at the Carl Road Lift Station Replacement.
    • Awarded the bid for bituminous resurfacing of town roads to Amherst Paving at a cost of $223,005.95.
    • Authorized the supervisor to sign the contracts from the NYS Hazard Abatement Board awarding the town a $10,000 Occupational Safety & Health Grant.
    • Approved a revised site plan for Island Farm Market at 2920 Grand Island Blvd. that includes screening, revised setback lines, inclusion of the Boulevard’s planting plan and future sidewalk plan.
    • Re-affirmed preliminary approval of Island Meadows Subdivision Phases 3A and B.
    • Reaffirmed preliminary plat approval for Scenic Woods Subdivision – Phase I – six lots on Love Road.

    Town Board Sets Four Public Hearings For Aug. 7

       Monday, July 17, 2006 . . .When the Town Board meets Monday, August 7 at 8 p.m., comments will be heard regarding a site plan for Abraxis Pharmaceutical Products, a rezoning issue on Whitehaven Road and a proposed Hyundai dealership and conservation easement for Fuccillo Automotive Group.
       Abraxis Pharmaceutical Products at 3159 Staley Road is requesting site plan approval for two minor additions: a 976 sq. ft. cooler addition and a 960 sq. ft. alcohol storage building. The additions would be constructed on an open area of black top that does not involve loss of parking spaces. The Planning Board is recommending site plan approval.
       Landscapers Jerod and Jim Battaglia are requesting the rezoning of 2569 Whitehaven Road from M-1 to M-2 to allow for a contractor’s storage yard. Several residents spoke at the Planning Board meeting objecting to the rezoning and airing concerns about the state of disrepair that already exists on the property (the old Calabro Chevrolet building).
       Two public hearings will address a site plan for an 11.77 acre Hyundai Dealership at Fuccillo Automotive Group on Alvin Road and a conservation easement and active oversight that the town is seeking on the site. A Fuccillo representative spoke Monday about the fact that the Automotive Group is allowing for more green space than is required and seeks only a basic easement for which the town should be a passive overseer. A super Chevrolet store, originally scheduled to precede the Hyundai dealership, has been put on hold due to current business conditions.

    Town Is Lead Agency On Approved Isle Waterfront Plan

       Monday, July 17, 2006 . . .After five years of work, the Local Waterfront Revitalization Program was adopted in three separate actions Monday. Supervisor Peter McMahon was directed to execute the SEQRA Findings Statement, the LWRP was approved and the supervisor was authorized to formally transmit the adopted LWRP and all related local implementing laws to the NYS Secretary of State for approval.
       The LWRP includes delineation of a waterfront revitalization area; an inventory of existing natural and manmade conditions within the waterfront area as well as an analysis of the opportunities and constraints to future development. It also contains policies for use, protection and development of the waterfront, recommended land and water uses and specific projects, a description of local laws, regulations, a description of federal and state programs likely to affect and necessary to further implement the LWRP, a description of local commitment and for preparation of the LWRP and the consultation efforts undertaken with affected state, federal and local agencies.
       The town, as lead agency, will govern actions in the waterfront area and oversee several projects that were identified to provide positive impacts by enhancing public access to the waterfront such as: Niagara River Greenway Commission Planning, West River Trailway System, Environmental Education Center at Beaver Island State Park, Scenic Woods/Spicer Creek Wetlands/Bicentennial Park Recreational Trail System, Grand Island Bike Trail Connection Project, Fisherman’s Park, Big Six Mile Creek Marina Improvements, and more.

       Monday, July 17, 2006 . . .Reverend Kevin Backus was presented a proclamation by the Town Board Monday commemorating the 300th anniversary of organized Presbyterianism in North America and the 70th anniversary of Bible Presbyterian Church. The 70th Annual Synod will be hosted by Bible Presbyterian Church on Grand Island August 3-8.
       Joshua Shilling of Boy Scout Troop 510, sponsored by Trinity United Church, was recognized for attaining the rank of Eagle Scout. He completed an Eagle Scout Project that improved the Herschell Carrousel Museum’s main entrance that involved directing 20 other scouts and some volunteers over a period of 115 service hours. The museum is located in North Tonawanda and contains a working carousel.

    Dear Supervisor McMahon:
       I wanted to thank you and the Town Board once again for your support for the mobile auto bureau located at the Town Hall. The level of inter-municipal cooperation demonstrated by the Town of Grand Island when we established this is to be commended and is certainly a model for other communities.
       I thought you would be interested in an update on the number of residents served at your location since the beginning of 2006. From January through June, 1833 transactions were recorded, most of whom are Grand Island residents. This does not include the scores of individuals who stop in to ask questions and pick up forms, and simply appreciate the convenience of not traveling and waiting at the other Auto Bureau locations for information.
       Your continued effort to get the word out about this service is encouraged. Each transaction that occurs in Erie County, rather than in a neighboring county or through the mail, results in much needed revenue for Erie County, which benefits every County taxpayer. I will continue to keep you apprised of the success of the mobile unit and again, please extend my appreciation to your colleagues as well. If you have any questions or concerns, please let me know.

    Town of Grand Island Part-Time Dog Control Officer - 2006

       The position of Part-Time Dog Control Officer involves responding to various dog and/or other animal complaints on weekends and/or when the full-time dog control officer is unavailable. Work is performed under the direction of the full-time dog control officer or the Town Board. Applicants should posses a good knowledge of the community, valid NYS driver’s license, and ability to handle dogs or other animals. High school diploma, GED or equivalent experience and training required. Pay is $12.12/hr. Any interested community member should submit a letter detailing his/her qualifications to:

    Park Place Patio Home Public Hearing Postponed

       Monday, July 3, 2006 . . .A public hearing, Monday, to air the Park Place Patio Home project was rescheduled for 8 p.m. Monday, July 17 due to an error in the public hearing notice that said discussion would consider preliminary plat approval. It should have read cluster development approval.
       A second public hearing regarding Jerod and Jim Battaglia’s request to rezone 2569 Whitehaven Road from M1-M2 for a contractor’s yard brought questions and comments regarding specifics of the project. Since there is no site plan yet, residents were asked to follow the project and were told they would have another chance to speak at a subsequent public hearing following Planning Board action.
       Barbara Johnson, who lives across the street from the property, voiced concerns about the traffic problems on Whitehaven from Fuccillo Automotive group test driving cars at 80 miles an hour to senior citizens driving slowly. She stated that failure to grade the road made it unsafe and said she didn’t allow her children to bike on the road. Johnson concluded that additional traffic with the addition of a contractor’s yard would just add to the safety concerns. The rezoning request was referred to the Planning Board for review and recommendation.
       Public hearings were set for 8 p.m. July 17 to consider closing roads for two block parties: Park Place, Bonnywoods and Forest Creek August 20 from 1:30-8 p.m. and through traffic on Wallace Drive between Huth Road and South Park from 2-4 p.m.
       Referred to the Conservation Commission was a Deed of Conservation Easement between the Town and Fuccillo Automotive Group that would protect the wetlands on the property. This easement would assure that the property will be retained forever in its wetland conditions and prevent any use of the property that would impair or interfere with the conservation values of the property.
       Councilwoman Mary Cooke announced that the town was given a grant in the amount of $10,000 from the State Department of Environmental Conservation for eradication of two acres of purple loosestrife using herbivorous insects (beetles). The Town will match the $10,000 amount.
       The Town Board accepted as complete the Final Supplemental Generic Environmental Impact Statement for the Local Waterfront Revitalization Plan. Involved was an update of potential environmental impacts with revisions circulated to the Department of State and to appropriate local, county, state and federal agencies in accordance with the requirements of Executive Law, Article 42 and Part 617 of the implementing regulations for Article 8 of the Environment Conservation Law.
       Rezoning was approved for Gun Creek, a residential mixed use development on 98.5 acres east of Stony Point and off Whitehaven Road. The project, as described by the developer, is a creative use of the land that would have 41 estate lots, 52 family lots, 83 patio homes and 98 town houses designed around green space as a focal point.

    Public Referendum Set On Firefighters Service Award Increase

       Monday, July 3, 2006 . . .Voters will go to the polls in a special election August 8 from noon to 8 p.m. to decide if Grand Island firemen’s service award should be increased from $480 to $590 for 2007 and be increased from $590.00 to $700.00 for 2008 and beyond.
       Grand Island Fire Company also wants to amend its Length of Service Award Program and change Provision #3 which gives an automatic 25 points to each elected and appointed official. The new #3 sets a maximum of 15 points for miscellaneous activities - "Participation in activities covered by the Volunteer Firefighters’ Benefit Law including but not limited to participation by paramedics and advanced EMTs in quality assurance meetings, Senior Assistance visits, fire prevention and education activities, a sitting member and participant in committee or Board of Directors meetings and other activities defined by the Administrator as being necessary to the operation of the Fire Company for the purpose of improving service to the community. One point per session of at least two hours in duration."
       The election, which will be held at Grand Island Fire Headquarters at 2275 Baseline Road, is open to all registered voters in the town. Absentee ballots will be available at the Erie County Board of Elections or from the Grand Island Town Clerk. Six election inspectors will oversee the vote – three Republicans and three Democrats to be named by the inspector chairpersons. The Fire Company will assume all costs associated with this referendum.

    Changes In Town’s Performance Service Contract Approved

       Monday, July 3, 2006 . . . Additional work in the amount of $132,000 for improvements to town facilities was approved Monday. Change orders included:
    • $34,400 for costs associated with installation of an emergency generator at the Golden Age Center.
    • $16,988 for installation of HVAC in the Golden Age Center kitchen.
    • $14,542.72 for modifications to the courtroom heating and air conditioning.
    • $3,124.80 for installation of window tint to the Town Hall first floor windows.
    • $28,518.76 for installation of doors and windows at the Highway Garage.
       The additional costs are within the original amount authorized.
       A change order for the Golden Age Center roof replacement was approved that will take care of a severely deteriorated atrium skylight and repairs to the building exterior. This will result in a net increase to the contract of $82,368. Funds for this are available under the original borrowing as reimbursements from the participating grant program have offset planned indebtedness.
       Supervisor Peter McMahon was authorized to sign a grant disbursement agreement for the Community Capital Assistance Program Grant ($50,000 from Sam Hoyt) to construct lavatories at Veterans Park.
       In other business, the board:
    • Approved the hiring of one part-time seasonal laborer as summer help in the Wastewater Department at the rate of $8.25 per hour effective July 10.
    • Approved hiring Patricia Kostenbauder and Jill Sweeney (at $15 per hour) as instructors in the Summer Youth Program and Roger Wright and Susan Szczublewski (at $20 per hour) for the Summer Nature Program.
    • Accepted with regret the resignation of Dog Control Officer Robert Meyer and approved advertising for a replacement.
    • Authorized advertising for a medium size dump truck for the Water Department.
    • Granted a special use renewal to Florence Prawel for the keeping of three horses at 2400 Fix Road.
    • Referred to the Town Board a letter requesting negotiations for a successor agreement between American Federation of State, County and Municipal Employees, AFL-CIO and the Town.
    • Corrected by amendment the measurement of an abandoned paper street, Fourth Street, from 150 ft. to 157.24 ft.

    Town Proclaims July 15 Friends of Lynnette Bike Tour Day

       Monday, July 3, 2006 . . .A large contingent of friends of Lynnette Grisanti was on hand Monday to receive a proclamation in honor of the 13th Annual Bike Tour in memory of Lynnette and her eight-week-old grandson, both of whom died of cancer. The Bike Tour will take place Saturday, July 15 with registration beginning at 8:15 a.m. at the Nike Base. Two tours are offered – one at 10 miles and one at 22 miles. A Chinese auction is another feature of this year’s event. A preview of the Chinese auction items will be held from 6:30-8:30 p.m. on the 14th. Ticket sales begin at 8 a.m. on the 15th with drawings to begin at 9:30 a.m.
       Bike tour proceeds benefit Friends of Children with Cancer at Roswell Cancer Institute. Over the past 12 years more than $40,000 have been donated to Roswell from this Isle event. The Town Board encouraged all residents to support the cause.
